This is the first report of the commission appointed to undertake dialogue with Canadians on the future of Canada's public health care system and to make recommendations for ensuring the long-term sustainability of the system. It focusses on results of the fact-finding work of the commission and begins with an overview of the commission's research process. The main section reviews what the commission heard & learned regarding four themes: Canadian values and how they are & should be reflected in the Canada Health Act; health system sustainability & funding; health care quality & access; and leadership, collaboration, & responsibility. The final section discusses three major challenges to be addressed in the next phase of the commission's work, a national consultation with Canadians. The appendix includes a summary of commission work during the fact-finding phase and information on the commission's research program

This report presents finding of a citizen dialogue project that involved 12 sessions held across Canada, each with about 40 randomly selected citizens who were asked to reflect upon four scenarios for reforming the health care system. Scenario 1 explores more public investment the system; scenario 2 involves a form of private payment for health care; scenario 3 offers a more radical restructuring of health care to create a parallel private system; and scenario 4 proposes a major internal restructuring to reorganize service delivery. The participants used information in these scenarios to create their own vision of a future health care system and then worked through the difficult trade-offs & choices to realize their vision. The project also verified the dialogue through a national poll of 1,600 Canadians. The report provides two kinds of analysis of citizens' responses: quantitative analysis of the pre- and post-dialogue questionnaires and the national poll, and qualitative analysis of the video tapes & observers' notes of each session. The Charter of Rights & Freedoms, as part of the Canadian Constitution, regulates governments' decisions about health care services. The Charter does not expressly guarantee either a right to health or a right of access to health care, but its general rights provisions, such as equality rights, cover many aspects of the health care system. Since the Charter's enactment in 1982, persons have brought court actions that use Charter rights to challenge health care policies. This paper describes the Charter's application in the health care field. It focusses on the Charter rights with most relevance for health care decisions, summarizing briefly the jurisprudence under sections 7, 15, and to a lesser extent, section 6. It then examines in closer detail the jurisprudence under section 1, and discusses the relevance of international jurisprudence. The last part gives an overall analysis of the Charter's potential impact on health care costs
