Ce recueil de 100 poèmes a été publié le 25 juin 1857 à Paris chez Poulet-Malassis. Ce recueil est mal accueilli, par la critique. Seuls quelques-uns, dont son ami Barbey d'Aurevilly, défendent la poésie de Charles Baudelaire. Le 5 juillet 1857 parait un violent article du Figaro, qui tout à la fois assure une grande notoriété au poète et le conduit devant les tribunaux. En août 1857, six mois après le procès de Madame Bovary (pour des chefs d'inculpation similaires: immoralité et obscénité), Baudelaire est condamné (Flaubert ne l'avait pas été) pour "offense à la morale publique, la morale religieuse et aux bonnes mœurs". Il est condamné à 300 francs d'amende et à la suppression de six poèmes. Ces 6 poèmes seront publiés à nouveau, en 1864, en Belgique dans le Parnasse satyrique du dix-neuvième siècle. Baudelaire a apporté un soin particulier à la disposition de son recueil. Les Fleurs du Mal ne sont pas une succession de poèmes qui prennent place au fur et mesure de l'inspiration de l'auteur. Baudelaire les a disposés suivant un itinéraire bien précis = Baudelaire's poetry was well-known long before it was collected in Les Fleurs du mal in 1857. A few scattered poems had appeared in journals and reviews, and Baudelaire had also achieved notoriety reciting his lurid verses aloud. Les Fleurs du mal appeared on the bookshelves of Paris in June 1857. Eleven hundred copies had been printed for sale, with an additional twenty copies hors commerce printed on fine paper. Within a month, the French government initiated an action against the author and the publisher, accusing them of outrages to public morality. On August 20th, a French court acknowledged the literary merit of the book as a whole but demanded that six poems be deleted on moral grounds. In a pattern now familiar, however, the trial only served to create a sensation, and by the following summer the initial printing of Les Fleurs du mal was sold out
