The freedom of the seas -- meaning both the oceans of the world and coastal waters -- has been among the most contentious issues in international law for the past four hundred years. The most influential argument in favour of freedom of navigation, trade, and fishing was that put forth by the Dutch theorist Hugo Grotius in his 1609 'Mare Liberum'. "The Free Sea" was originally published in order to buttress Dutch claims of access to the lucrative markets of the East Indies. It had been composed as the twelfth chapter of a larger work, "De Jure Praedae" ('On the Law of Prize and Booty'), which Grotius had written to defend the Dutch East India Company's capture in 1603 of a rich Portuguese merchant ship in the Straits of Singapore. This new edition publishes the only translation of Grotius's masterpiece undertaken in his own lifetime -- a work left in manuscript by the English historian and promoter of overseas exploration Richard Hakluyt (1552-1616). This volume also contains William Welwod's critque of Grotius (reprinted for the first time since the seventeenth century) and Grotius's reply to Welwod. Taken together, these documents provide an indispensable introduction to modern ideas of sovereignty and property as they emerged from the early-modern tradition of natural law. -- Back cover

This monograph is a study of the interaction of politics and political theory in The Netherlands and Asia in the early seventeenth century. Its focal point is the Dutch jurist Hugo Grotius (1583-1645), who developed his rights and contract theories for the benefit of the United Dutch East India Company or VOC. The monograph reconstructs the immediate historical context of his political thought, as conceptualized in his early manuscript De Jure Praedae/On the Law of Prize and Booty and Mare Liberum/The Free Sea (1609). It argues that Grotius' justification of Dutch interloping in the colonial empires of Spain and Portugal made possible the VOC's rise to power in the Malay Archipelago, which resulted in the slow, but steady, loss of selfdetermination on the part of the inhabitants of the Spice Islands

In this work, Grotius examines the historical, political, and legal aspects of war and sets forth a foundation for international law because of his argument against the territorial sovereignty of the world's coastal waters. The manuscript resulted from a dispute arose between the united kingdom of Spain and Portugal and the Dutch. Spain-Portugal claimed a monopoly on trade with the East Indies. In 1604, after a Dutch admiral seized the Portuguese vessel Santa Catarina, the Dutch East India Company asked Grotius to produce a work legally defending that action. Their grounds were that, by claiming a monopoly on the right of trade, Spain-Portugal had deprived the Dutch of their natural trading rights. Grotius's De Jure Praedae was unpublished during his lifetime, except for one chapter, Mare Liberum ("The Freedom of the Seas"). This chapter buttressed the Dutch position in the negotiations for the Twelve Years' Truce with Spain that were concluded in 1609
