The doctrine of judicial review : its legal and historical basis, and other essays by
Edward S Corwin(
Book
)
50 editions published between 1914 and 2017 in English and Undetermined and held by 1,388 WorldCat member libraries worldwide
"This book, first published in 1914, contains five historical essays. Three of them are on the concept of judicial review, which is defined as the power of a court to review and invalidate unlawful acts by the legislative and executive branches of government. One chapter addresses the historical controversy over states' rights. Another concerns the Pelatiah Webster Myth?the notion that the US Constitution was the work of a single person. In "Marbury v. Madison and the Doctrine of Judicial Review," Edward S. Corwin analyzes the legal source of the power of the Supreme Court to review acts of Congress. "We, the People" examines the rights of states in relation to secession and nullification. "The Pelatiah Webster Myth" demolishes Hannis Taylor's thesis that Webster was the "secret" author of the constitution. "The Dred Scott Decision" considers Chief Justice Taney's argument concerning Scott's title to citizenship under the Constitution. "Some Possibilities in the Way of Treaty-Making" discusses how the US Constitution relates to international treaties. Matthew J. Franck's new introduction to this centennial edition situates Corwin's career in the history of judicial review both as a concept and as a political reality."--Provided by publisher

Edward S. Corwin (1878-1963) is widely recognized as the most eminent commentator on the Constitution in our century. Largely because Corwin died before he could write the single definitive work he had planned, the political scientist Richard Loss has spent over a decade compiling and editing a three-volume collection of Corwin's major essays.Loss has chosen twelve essays for the final volume that state Corwin's arguments in political thought and constitutional law. They are responsive to the theme of limitations on governmental power. The editor has organized the essays under the headings "The Limits of Governmental Power over Property and Business," "Governmental Action and Personal and Social Rights," and "A Nation and the States." He has also included Corwin's spirited and previously unpublished address "The New Deal in the Light of American Political and Constitutional Ideas."

Book
)

"The future of the presidency is today shrouded in doubt, and for good reason when we consider the part that crisis has played in the expansion of its importance. Should one man have available the immense powers that are today the President's for the asking--indeed for the taking? It seems to the authors that the time has arrived for us to recognize that crisis, and especially international crisis, has become a constant factor of national existence, and that reliance on intermittent recourse to presidential dictatorship is no longer the safe answer"--Introduction, page vii

This classic look at the executive position from the constitutional point of view was first written in 1940 and revised in 1957 by Corwin himself. Bland, Hindson and Peltason have updated this monumental work to include an undeclared American war in South East Asia, military involvements in the Mideast and Latin America, criminal and political misdeeds in the White House, four constitutional amendments and seven Presidents. Leaving the original study intact, they have added for each chapter a lengthy postscript summarizing post-1957 events and a new selected bibliography. The study presents the President as a Commander in Chief in peace and war; as head of the Federal bureaucracy, as tribune of the people, political chieftain and legislative leader and as a director of foreign relation. Includes a new introduction and revised table of cases. ISBN 0-8147-1391-2 (pbk.) : $20.00
