The central questions of this research are the following: What was the Antarctic policy of the Netherlands from the late 1950s until 1990? What were its motives, goals, means and effects? What were the roles of the government, the scientific community, non-governmental organisations and possible other actors in this policy? How can these be explained? The focus of this study is on Dutch Antarctic policy. In order to explain Dutch Antarctic policy from the late 1950s until 1990 and to place it in a broader context, Dutch policy will be compared with the Antarctic policies of Belgium and Germany (Federal Republic of Germany, FRG) in the same period. 6 The comparison offers insights into the functioning of the ATS and into the roles - if any - of the three countries in this international regime in the period under investigation. This adds another central question to this research: How does Dutch Antarctic policy compare with the Belgian and German Antarctic policies in the same period? This research will not focus on the actual Antarctic scientific research activities of the Netherlands, Belgium and Germany from the late 1950s until 1990 but will concentrate on their Antarctic policies. This book presents a comprehensive study on the advance tax ruling, a legal instrument provided by the tax authorities to a specific taxpayer upon his request. The ruling - on which, to a certain extent, the taxpayer is entitled to rely - consists of any advice, information or statement concerning the taxpayer's tax situation in respect of future transactions. The book begins by identifying some rudiments of tax rulings in Roman law, and traces the historical development of tax rulings systems in the United States, the Netherlands and Italy. The advance tax ruling is defined and its legal nature within the American, Dutch and Italian legal systems is analysed. A distinction is made between advance tax rulings and other forms of guidance provided by the tax administration. The main procedural and substantive elements of current advance tax rulings systems worldwide are investigated, and the legal principles underlying advance tax rulings procedures in the United States, the Netherlands and Italy are identified. In the final chapters, an overview of the status quo of advance tax rulings systems in the EU Member States is followed by a discussion concerning the harmonization of advance rulings systems in the European Union. On the basis of European legal principles - including those arising out of the harmful tax competition debate - the substantive and procedural elements of a harmonized advance tax rulings system in EU Member States are discussed by taking as a point of reference the European rulings in the field of customs duties (i.e. binding tariff information)
