Constitutional law in a nutshell by Jerome A Barron( Book )

116 editions published between 1983 and 2017 in 3 languages and held by 3,052 WorldCat member libraries worldwide

aThis 9th edition of Constitutional Law in a Nutshell summarizes constitutional law from Marbury v. Madison (1803) to the present. This edition features some new and controversial cases. A new and famous example is Obergefell v. Hodges (2015) which held, per Justice Kennedy, 5-4, that under both the Due Process and the Equal Protection Clauses of the Fourteenth Amendment "same sex couples may exercise the fundamental right to marry in all States. "In Fisher v. University of Texas (2016) the Court held, 4-3, per Justice Kennedy, that the much litigated, race-conscious admissions program of the University of Texas was valid under the Equal Protection Clause. In the area of "a woman's right to decide to have an abortion, "the Court in Whole Women's Health v. Hellerstedt (2016) upheld, 5-2, the use of rigorous undue burden standard as the measure of the abortion right. The Court ruled that two provisions of a Texas law targeting the state's abortion clinics were unconstitutional under the Fourteenth Amendment. The First Amendment, as always, continues to generate new and important decisions. Thus, Reed v. Gilbert (2015) held that a town sign ordinance violated the First Amendment. The court indicated that any speech regulation directed to a specific subject matter should be evaluated under the strict scrutiny standard. The decision leaves open a question as to whether this ruling is intended to be applied to previously less protected categories of expression. This edition, of course, contains numerous other important decisions. The objective is to summarize the essence of the Court decisions and to do so in a concise and understandable way

Freedom of the press for whom? the right of access to mass media by Jerome A Barron( Book )

19 editions published between 1973 and 1993 in English and held by 1,167 WorldCat member libraries worldwide

Freedom of the press has always meant freedom from government control and censorship, but now the communications industry itself is the major censor, with control of access to the media resting in a very few hands. The new effort throughout the country to open up the media by applying citizen group pressure, by bringing court action, and by prodding federal agencies is chronicled. A critical analysis of how the media presently function is provided, along with a guide to the means by which public access to the media can be obtained. (Author/RH)
Mass communication law : cases and comment by Donald M Gillmor( Book )

26 editions published between 1969 and 1990 in English and Undetermined and held by 874 WorldCat member libraries worldwide

The teaching materials presented in this casebook combine two perspectives: that of the journalist and that of the lawyer. The holdings of the courts on cases involving the First Amendment, libel, pornography, fair trial, free press, and the regulation of radio and television broadcasting are presented. In addition some problems of law and journalism are discussed more briefly--freedom of information, the right of privacy, advertising, copyright, etc. The casebook relies mainly on the words of the judges themselves and provides comments and questions for discussion. Appendices contain the report of the Committee on the Operation of the Jury System on the "Free Press-Free Trial" Issue, the case of Red Lion Broadcasting V. Federal Communications Commission, and selected provisions of the Federal Communications Act of 1934. a subject index is also provided. (Jy)
