The paper highlights that a member's currency held by the IMF in accounts other than the General Resources Account is not subject under the IMF's Articles of Agreement to the principle of maintenance of value in terms of the SDR that applies to currency held in the IMF's General Resources Account. The IMF has express or implied powers to invest holdings in accounts to which no obligation to maintain value is attached

This paper discusses Article IV, Section 8 of the Articles of Agreement which states the requirement of maintenance of the gold value of the IMF's assets. Each member of the IMF is bound to maintain the gold value of the IMF's holdings of the member's currency notwithstanding changes in the par or foreign exchange value of the currency. This obligation applies to devaluation, depreciation, revaluation, and appreciation. It prevents the IMF from making profits or sustaining losses as a result of changes in the value of its currency holdings. An additional purpose is to enable the IMF to continue to conduct its operations in a manner consistent with its purposes, notwithstanding such changes

This paper discusses some events that led to beginning of the IMF reform. At the Twenty-Second Annual Meeting of the Board of Governors at Rio de Janeiro in September 1967, certain Governors urged that proposals for the amendment of the Articles to establish the special drawing rights facility must be accompanied by other proposals that became known as proposals to reform the IMF. The Board of Governors adopted a Resolution at Rio de Janeiro in which the Executive Directors were requested to proceed with their work relating to the proposed facility, on the basis of the Outline attached to the Resolution, and also improvements in the present rules and practices of the IMF

This paper examines the IMF's concepts of convertibility and gives some impression of their purposes. The central concept of convertibility in the Articles is the convertibility of Article VIII, Sections 2, 3, and 4. Under it, the basic rule is that members must avoid restrictions on the making of payments and transfers for current international transactions, multiple currency practices, and discriminatory currency arrangements. In addition, a member that has accepted the obligations of Article VIII must convert balances of its currency in certain circumstances when those balances are presented for conversion by the monetary authorities of another member

This paper discusses the Cuban insurance cases. The litigation in U.S. courts in which claims have been made under life insurance policies issued by U.S. or Canadian companies to applicants then resident in Cuba is the most extensive body of cases involving Article VIII, Section 2(6) that has come into the courts. The cases suggest that the benefits of Article VIII, Section 2(6), cease to be available to a country once it withdraws from the IMF, even in respect of contracts entered into when the country was a member. This conclusion seems to have been accepted by both courts and counsel in the cases
