The two-volume set is arranged by theme: criminal law; governmental power; economic regulation; race, gender, sexuality and disability; and civil liberties. Each case features an information box providing the case's vital statistics (date, location, court, principal participants, and significance), a 1,000-5,000 word essay (201 in all) penned by one of 85 scholars (lawyers, legal historians, social scientists, humanities professors, etc.) identified by name and affiliation. Thematic sections are preceded by concise introductions, and the essays 43 new to this edition concentrate "on the narrative, dramatic dimension of legal disputes within their larger social and historical contexts." Some essays have been cut and many revised for this edition. New cases include Bill Clinton's, and the disability case regarding golfer Casey Martin who, because of a disease affecting his right leg, wanted to use a prohibited golf cart in the PGA Tour. The struggle for student rights : Tinker v. Des Moines and the 1960s by John W Johnson( Book )

5 editions published in 1997 in English and held by 712 WorldCat member libraries worldwide

Tension between free speech and social stability has been a central concern throughout American history. In the 1960s that concern reached a fever pitch with the anti-Vietnam War movement. When antiwar sentiment "invaded" American schools, official resolve to retain order in the classroom vied with the rights of students to speak freely. A key event in that face-off was the Supreme Court decision in Tinker v. Des Moines. As the most important student rights case ever to reach the Supreme Court, Tinker raises important issues regarding First Amendment freedoms and provides a fascinating legal window on a turbulent era

Affirmative action by John W Johnson( Book )

2 editions published in 2009 in English and held by 279 WorldCat member libraries worldwide

Affirmative Action recounts the fascinating history of a civil rights provision considered vital to protecting and promoting equality, but still bitterly contested in the courts, and in the court of public opinion. The notion of affording special consideration to racial minorities and/or women in employment, government contracting, and education has divided once-unified coalitions, affected elections at the state and federal levels, sparked angry popular referenda, and occasioned major Supreme Court decisions. Today, more than 40 years after the birth of affirmative action, strident voices on all sides of the debate continue to clamor for a hearing. "Special consideration" or "reverse discrimination"? This examination traces the genesis and development of affirmative action and the continuing controversy that constitutes the story of racial and gender preferences. It pays attention to the individuals, the events, and the ideas that spawned federal and selected state affirmative action policies, and the resistance to those policies. Perhaps most important, it probes the key legal challenges to affirmative action in the nation's courts. The controversy over affirmative action in America has been marked by a persistent tension between its advocates, who emphasize the necessity of overcoming historical patterns of racial and gender injustice, and its critics, who insist on the integrity of color and gender blindness. In the wake of related U.S. Supreme Court decisions of 2007, this volume brings the story of one of the most embattled public policy issues of the last half century up to date, demonstrating that social justice cannot simply be legislated into existence, nor can voices on either side of the debate be ignored
