Additional chapters focus on contemporary legal problems faced by schools: regulation of student conduct; liability for injury to students; management of school property; the legal aspects of providing transportation; the financing of education; the relationships between religion, education, and government in both public and private schools; and requirements for desegregation. Prepared as a layman's summary of the current state of the law, this document omits the footnotes and case citations typically found in legal analyses in favor of brevity and readability. This volume presents an analysis and synthesis of the opinions of the Supreme Court explaining judgments that have directly decided education matters and those that have had substantial impact on public education policies and procedures even though the parties to the suits were not connected with public education. The chapters are structured thematically to highlight, in an integrated fashion, the main thrusts of the Supreme Court opinions. The cases within each area are usually presented in chronological order. Four chapters cover issues on teacher rights (the loyalty turmoil, expression and due process, conditions of employment, and discriminatory employment practices); three chapters describe cases on race and education; and two chapters concern financial aid for parochial schools. A single chapter is devoted to each of the following subjects: financial aid for secular private schools, religious influences in public schools, student rights, liability for civil rights violation, structure and finance of school districts, and federal legislation affecting education. In March of 1971, the Supreme Court of the United States ruled that "if an employment practice which operates to exclude Negroes cannot be shown to be related to job performance, the practice is prohibited." Although the decided case concerned discrimination on the basis of race, the act also bars discrimination because of religion, sex, or national origin. The instant case was brought as a class action by black employees of a North Carolina plant of the privately owned Duke Power Company. Some four months after this Supreme Court decision, a Federal District Court issued an injunction halting the use in the New York City school system of certain examinations as a basis for appointment to supervisory or administrative posts. This court, although noting "Griggs vs. Duke Power Company", based its ruling on constitutional grounds. At the time the suit was instituted, obtaining a permanent supervisory position required not only meeting State certification requirements but also obtaining a City license. The latter was attainable only on passing an examination prepared by the Board of Examiners. Plaintiffs were a black and a Puerto Rican, both of whom had State Certificates, met educational and experience requirements of the City Board, and were serving as acting principals of elementary schools.
