This volume offers a unique reflection on the historic and contemporary influence of the New Approaches to International Law (NAIL) movement within the context of Europe and America. In particular, the contributions focus on the intellectual product of NAIL's founder, David Kennedy, in relation to three legal streams: human rights, legal history, and the law of war. On the one hand, the volume is valuable reading for a broad audience interested in the current challenges facing global governance, and how critical studies might contribute to innovative intellectual and practice-oriented developments in international law. On the other hand, stemming from a 2010 seminar in Madrid that brought together scholars to discuss David Kennedy's scholarship over the last three decades, the contributions here are a testament to the community and ideas of the NAIL tradition.  The volume includes scholars from a wide field of legal interests and backgrounds.   Professor José María Beneyto is Director of the Institute for European Studies at CEU San Pablo University Madrid, Spain. El autor analiza en esta obra el pensamiento histórico de Juan Donoso Cortés (1809-1853), el filósofo y el estadista, dentro del contexto de las actuales teorías de la historia. Fórmulas tales como "transformación de la ilustración en mitología" (Adorno/Horkheimer), "la historia como narración de historias" (Koselleck), "conciliación de mito y razón" (Marquard) o "nuevo esteticismo" (Bohrer) tienen hoy vigencia, para no hablar de conceptos como "posmodernidad" o "nueva complejidad" En el siglo XIX se hablaba de la agonía de la Ilustración. En su primera juventud Donoso Cortés fue un optimista entusiasta del progreso. Poco a poco surgieron en él las dudas, vio el carácter dictatorial de una Ilustración "consecuente" y al final rechazó toda "civilización filosófica" para adoptar una "cultura católica", en la que San Agustín y Bossuet fueron sus mentores y guías. Donoso deseaba que la escatología cristiana ejerciera su función social, y así, se da una remitificación de la filosofía racional de la historia. En este aspecto resulta muy singular la conexión con el actual debate filosófico, pues la mezcla de ficta y facta es un tema fundamental del más reciente saber histórico (Hayden White, Reinhart Koselleck) en el que se discuten las fronteras de la ratio y de la factibilidad

It is based on the view that the European Union and its constitutional law cannot be isolated from its Member States and their respective constitutions, which are part of European constitutional law, and that the case law of the national courts, in particular the constitutional and supreme courts of the Member States, needs to be considered as much as the jurisprudence of the European Court of Justice. "This book is based on an international project conducted by the Institute for European Studies of the University CEU San Pablo in Madrid and a seminar on Vitoria and International Law which took place on July 2nd 2015 in the convent of San Esteban, the place where Vitoria spent his most productive years as Chair of Theology at the University of Salamanca. It argues that Vitoria not only lived at a time bridging the Middle Ages and Modernity, but also that his thoughts went beyond the times he lived in, giving us inspiration for meeting current challenges that could also be described as "modern" or even post-modern. There has been renewed interest in Francisco de Vitoria in the last few years, and he is now at the centre of a debate on such central international topics as political modernity, colonialism, the discovery of the "Other" and the legitimation of military interventions. All these subjects include Vitoria's contributions to the formation of the idea of modernity and modern international law. The book explores two concepts of modernity: one referring to the post-medieval ages and the other to our times. It discusses the connections between the challenges that the New World posed for XVIth century thinkers and those that we are currently facing, for example those related to the cyberworld. It also addresses the idea of international law and the legitimation of the use of force, two concepts that are at the core of Vitoria's texts, in the context of "modern" problems related to a multipolar world and the war against terrorism.
