Hugo de Groot ou Grotius (1583-1645) fut "homme de loi, homme de foi, homme de lettres." Dans son oeuvre prodigieuse, les De jure belli ac pacis libri tres occupent une place centrale. Malgre le titre - emprunte au Pro Balbo de ciceron - qu'il a donne a son traite du Droit de la guerre et de la paix, Grotius semble moins soucieux d'ouvrir la voie, comme on l'a souvent repete, au droit international moderne que d'inaugurer, par une revolution epistemologique, une science du droit systematique et reationnelle. A partir de l'exemple topique de la guerre, il en adosse l'edifice a une somptueuse axiomatique du "droit naturel," qu'il distingue du "droit volontaire" et concoit comme le dictamen rationis que commande le principe de sociabilite. Sur cette base, le droit de la guerre peut - et doit - s'accomplir en droit de la paix

"In 1662 Pufendorf was appointed to the first modern professorship in natural law (at the University of Heidelberg). In 1670 he became professor of natural law at the University of Lund in Sweden. First published in 1672, this is his principle work and a landmark in the history of natural and international law. Beginning with a consideration of fundamental legal ideas and their various divisions, Pufendorf proceeded to a discussion of the validity of customs, the doctrines of necessity and innate human reason. The work is significant in part because it developed principles introduced by Grotius and Hobbes. Unlike Hobbes, Pufendorf argued that peace, not war, was the state of nature, and he proposed that international law was not restricted to Christendom." -- Lawbook Exchange
