In the negotiations for the Treaty on European Union, "subsidiarity" assumed central importance. This was the first time that the term was expressly incorporated with general effect into the Treaty. The principal provision is Article 3b, which reads: "The three main institutions of the Community legislature have all devoted attention to the principle and to its incorporation into their daily work." The integration of subsidiarity into the institutions' work will affect large amounts of legislative proposals as they arise. However, the European Court's a posteriori review of challenged legislation will of course affect future action by both administrators and legislators. If, for example, it became clear the Court would not in practice strike down Community acts for alleged conflict with Article 3b(2), there is a danger that the Commission's procedural safeguards would become peremptory
