This paper examines the growth of consumer vulnerability in relation to credit markets and the growth of the alternative finance sector. This sector includes cheque cashing & pay-day loan services, pawn brokers, rent-to-own firms, tax rebate discounters, loan brokers, and finance companies. Rationales & explanations for regulation of consumer markets are discussed along with explanations of existing patterns of regulation of low-income markets. The existing legal framework for regulating the alternative financial sector is evaluated with regard to regulation as a method of increasing informed decision-making and protecting consumers against harmful practices. The final section considers institutional developments which might reduce both the need to rely on high-priced credit and the existence of financial exclusion, as well as facilitating savings capacity among vulnerable consumers. The appendix contains a model Deferred Deposit Loan Act whose purpose is to protect consumers who enter into short-term, high-rate loans from abuses that occur in the credit marketplace when such lenders are unregulated
