Pero sostiene que es crucial el valor epistémico del procedimiento, es decir, que este sea reconocido como el que más se aproxima a una decisión adecuada. Ahora bien, si lo único que importa es tomar buenas decisiones, cabe preguntarse por qué no gobiernan los expertos, los más sabios. Estlund toma distancia de esta postura y argumenta que el superior conocimiento de unos pocos sólo puede servir como justificación política si resulta aceptable para todos los puntos de vista atendibles. Si se busca el mejor sistema político, sin duda este será democrático: un ideal regulativo que comprenda leyes y políticas autorizadas por el pueblo, que a su vez se sujeta a ellas.
