This thesis has for objective the verification of whether the member states of the echr are applying effectively the prohibition of torture and degrading and inhuman treatment as established by the article 3 ECHR. The analysis of the national laws of member states reveals that the putting into practice of this disposition has a contradictory aspect. If the enforcement application of article 3 has proven to be of limited impact, the European states have begun to develop a preventive application, which has proven to be more effective. The first part shows the recognition that despite of its universal character and the acknowledgement of the supreme value of the article 3 by all of the member states, its effect on administrative practice and national jurisprudence remains limited. The second part demonstrates that the European states are adjusting their domestic legal systems in accordance with the preventive European dispositions by reorienting the existent procedural guarantees toward the reinforcing of the rights and the protection of the individual, and in developing extra-procedural out of court measures designed to prevent attacks on human dignity

This thesis deals with regulatory and economic capital computation for retail banking credit risk. For regulatory capital computation, we put forward a loss-based approach at the one year horizon. Thus the model for portfolio aggregation is developped under two setups: Basel II and the so-called extended Basel II. Capital requirements are calculated with indicators from the loss distribution. We insist on the benefits of our more general correlation structure, core of the extended Basel II approach, to take into account the diversification effect. Next, we compute economic capital in an innovative value based framework. Capital is then defined as the expected value of the portfolio at the horizon, with a deduction for the Expected Shortfall of the distribution value

The work done in the framework of this thesis deal with the automatic faces identification in databases of digital images. The goal is to simplify biometric identification process that is seeking the query identity among all identities enrolled in the database, also called gallery. Indeed, the classical identification scheme is complex and requires large computational time especially in the case of large biometric databases. The original process that we propose here aims to reduce the complexity and to improve the computing time and the identification rate performances. In this biometric context, we proposed an unsupervised classification or clustering of facial images in order to partition the enrolled database into several coherent and well discriminated subsets. In fact, the clustering algorithm aims to extract, for each face, a specific set of descriptors, called signature. Three facial representation techniques have been developed in order to extract different and complementary information which describe the human face: two factorial methods of multidimensional analysis and data projection (namely called "Eigenfaces" and "Fisherfaces") and a method of extracting geometric Zernike moments. On the basis of the different signatures obtained for each face, several clustering methods are used in competing way in order to achieve the optimal classification which leads to a greater reduction of the gallery. We used either "mobile centers" methods type such as the K-means algorithm of MacQueen and that of Forgy, and the "agglomerative" method of BIRCH. Based on the dependency of the generated partitions, these different classifying strategies are then combined using a parallel architecture in order to maximize the reduction of the search space to the smallest subset of the database. The retained clusters in fine are those which contain the query identity with an almost certain probability

The comparison between the business secret under French and OHADA's Law shows that the secret is a living institution. The secret has for purpose the legal security and the promotion of economic activities especially in Africa where the law is place at the service of the development. The study has revealed a real global convergence on the necessity of a secret in the economic activities. The secret is connected with the sociological structure of the business and especially with the capital objective to save the originality. To that extend, it constitutes a true shield against industrial spying. This right to the secret, put under probation, is subject to some relativity so as to favour the implementation of the principles of business governance so as to improve the functioning of companies in a better transparency. The other attenuation concerning this right to the business secret is made for the benefit of the public authorities who defend the common interest. Eventually, the attactivity and the efficiency of economic activities in the two legal systems will depend on the control over the right to the secret and the right to be informed

RNA editing in plants organelle transcripts is a proccess leading to specific post-transcriptional pyrimidine interconversions (mainly C-to-U). Recently a few pentratricopeptide repeat (PPR) proteins were described to be essential in this process. During my PhD, I found that the DYW domain of PPR proteins show similarities with the active site of cytidine deaminases, and that the phylogenetic distribution of this domain is strictly correlated with RNA editing in green plants. In addition, in A. thaliana, the AtDYW1 gene encodes a protein made of a targeting signal to the organelles and a DYW domain. Mutant lines in which this gene has been targeted for knock-down exhibit strongly altered development. In the affected seedlings, AtDYW1 gene expression is specifically decreased, and several editing defects in plastids transcripts were characterized.Taken together, these data support the hypothesis that the DYW domain and the AtDYW1 protein may be the central enzyme in the RNA editing

Shock wave/boundary layer interactions in hypersonic flows may have major consequences on thermal loads, especially if the shock is strong enough to induce separation. The heat-flux levels in the interaction region strongly depend on the nature, laminar or turbulent of the boundary layer but special attention should be paid to transitional interactions which are likely to exist at altitude where the Mach number is high and the density low. This thesis is devoted to the experimental and numerical study of transitional interactions in hypersonic flow. The experiments were performed on a hollow cylinder-flare model in the Onera R2Ch wind tunnel at a Mach number of 5 and for varying stagnation pressure. Navier-Stokes simulations with the Nasca solver and stability calculations with the Castet code have also been performed to help in the data interpretation. Objectives of this work are (1) to build reference test cases in the domain of transitional interaction, (2) to evaluate the capacity of Navier Stokes codes to correctly simulate this interaction, and (3) to predict transition using stability calculations and factor N method. Wall pressure and heat-flux measurements, Laser Doppler Velocimetry (LDV) and Pitot boundary layer surveys, surface flow visualizations and schlieren photographs have been performed to provide a precise description of the flow field

The interest of dynamic modeling and control of the autonomous flying objects increased significantly during these last years. Complexity and capability of these flying objects are expanding rapidly now, and the range of missions their designed to support is growing. In order to fulfil this requirement, it is necessary, in one hand, to introduce the effect of the structural flexibility and the aerodynamic phenomenon in the dynamic model, and in the other hand, to build a suitable strategy of command and stabilization for these flying objects. The work is registered within this framework, and relates two types of engines: - Lighter than air vehicle: Application on the modelling and control of flexible airship. - Heavier than air vehicle: Application on the modelling and control of flexible micro-drone. We present a general model of autonomous flexible flying engine undergoing great overall motion and small elastic displacements. The formalism used is based on the Newton- Euler approach, which is frequently used for rigid flying objects. In this study we generalize the existing formalisms for rigid bodies, by including the effect of flexibility without destroying the total methodology. A modal synthesis is used. A hybrid method based on the energetic principles and Lagrange equations is presented. The phenomenon of the added masses is also taken into account. In order to integrate the fluid-structure interaction of a flexible airship, we develop an original analytical formulation of the problem using both the new notion of flexible flow potential, and the development of the kinetic energy of the air constrained by the motion and the vibration of the airship. This method allows to put in an obvious place the coupling "overall motion - flexibility" in the added mass matrix. We also present the dynamic and aerodynamic model of a flexible quadrirotor called XSF, designed in the IBISC laboratory and intended for an interuniversity competition for microdrones. A robust methodology based on the " Backstepping " control is realized to stabilize the airship around a desired position, and a PID controller is proposed to stabilise the XSF. The strategy of command is compelled by imperative to optimize the ratio precision/portability, to allow an easy insertion of the developed algorithms in the embedded electronics. A numerical validation is presented in the end of this report
Les gènes uniques chez les plantes caractéristiques, évolution et promoteurs by David Sergio Armisén Giménez( Book )

The main objectives of this thesis were (i) to search for the selection pressure exerted on plant orthologous genes and (ii) to describe the structural and functional features they share in particular in their promoters, in order to (iii) define a novel phylogenetic footprinting approach. Pairs of unique genes, defined by sequence comparisons, have been used because they were considered as having the greater chance to be true orthologues. Plant unique genes form three groups of genes with different structural, functional and evolutionary features. The unique genes that are specific either to Arabidopsis thaliana or Oryza sativa have features that are different than those of conserved unique genes. On one hand, the species-specific unique genes code preferentially for excreted peptides implied in regulatory functions. On the other hand, the conserved unique genes have characteristics described in genes implied in basal metabolism of the cells and which evolve slowly. Some potential regulatory motifs have been found over-represented only in the promoter of these genes. Lastly, after duplication, these genes generally lose one duplicate, which suggest a strong negative selection against the co-existence of two not diverged copies of the same gene
