Bittker on the regulation of interstate and foreign commerce by Brannon P Denning( Book )

3 editions published in 2013 in English and held by 98 WorldCat member libraries worldwide

"With its Lopez ruling in 1995, the US. Supreme Court signaled a new era in interpretation of the Commerce Clause of the Constitution. Boris Bittker, long one of the nation's pare-eminent tax authorities, turned his attention to analyzing this area of constitutional law, responding to the many unanswered questions in the wake of the Lopez decision, as well as the dramatic changes in other commerce areas, such as electronic commerce. Bittker on the Regulation of Interstate and Foreign Commerce is the only up-to-date treatise to examine the scope of the Commerce Clause, which is regarded as 'the king of the constitutional castle.' The book analyzes the entire unruly tangle of judicial opinions enunciating, refining, applying, and occasionally rejecting the dormant Commerce Clause, along with the Commerce Clause's other features and the four commerce-related provisions of the Constitution - the Import-Export Clause, the Tonnage Clause, the Federal Export Clause, and the Port Preference Clause. Together, the five constitutional provisions have the same target - state restrictions on national commerce. The book also explores and explains the effect of the interpretation of the commerce power on various industries, such as aviation, banking and financial services, insurance, and shipping"--Preliminary page

Bittker on the regulation of interstate & foreign commerce by Brannon P Denning( )

in English and held by 2 WorldCat member libraries worldwide

Boris Bittker, the universally recognized authority on federal taxation, turns his formidable talents with the assistance of Brannon P. Denning to an analysis of interstate and foreign commerce in this important work. With its Lopez ruling in 1995, the U.S. Supreme Court signaled a new era in interpretation of the Commerce Clause of the Constitution. Bittker and Denning respond to the many unanswered questions in the wake of the Lopez decision as well as the dramatic changes surrounding electronic commerce as they cover the full range of commerce topics, including the Federal Export Tax Bank, the Supremacy Clause, the Dormant Commerce Clause, economic protectionism by the states, commerce on the Internet, the Indian Commerce Clause, postal, military, and spending powers, the treaty power, the 21st Amendment, and much more. They also explore and explain the effect of the interpretation of the commerce power on various industries, including aviation, banking and financial services, insurance, and shipping. Their insightful analysis of court decisions illuminates the probable judicial approach to both existing and new legislation. With Bittker on the Regulation of Interstate and Foreign Commerce, the authors supply a valuable analysis of constitutional commerce doctrine

American constitutional law : powers and liberties by Calvin R Massey( Book )

1 edition published in 2019 in English and held by 1 WorldCat member library worldwide

Considerably shorter than most casebooks for the course, American Constitutional Law: Powers and Liberties is an effective teaching resource, providing the basics of constitutional theory without getting mired in pure theory. Professors have ample opportunity to shape the discussion and develop issues in their own way. Cases are well-selected and tightly edited, making them easy to grasp, and allowing the Court's voice to be heard without overwhelming the reader. All the topics in an introductory survey course are covered with minimal reliance on secondary sources, omitting extensive treatment of academic commentary. Well-written hypotheticals challenge student thinking during class preparation and provide a platform for class discussion. The author condenses some portions of constitutional law into narrative summaries and follows a sensible organization: an issue is introduced at the beginning of each part, chapter, and section, followed by relevant materials, and a tentative resolution of the problem. American Constitutional Law: Powers and Liberties can be used for a 4-unit, single-semester survey or a two-semester Con Law I and II course. The Fourth Edition sees a reduction in page length by selective removal of cases and sharp editing, and the material on commerce power and free speech has been reorganized. New Principal cases include United States v. Comstock, McDonald v. City of Chicago, Snyder v. Phelps, United States v. Stevens, Brown v. Entertainment Merchants Ass'n, and Citizens United v. Federal Election Commission. Major 2012 cases are introduced as new Principal or Note cases: The Health Care Cases, United States v. Alvarez, FCC v. Fox, and Arizona v. United States . Other new Note cases featured are Wyeth v. Levine, Arizona Christian School Tuition Organization v. Winn, Chamber of Commerce v. Whiting, Free Enterprise Fund v. Public Company Accounting Oversight Board, Holder v. Humanitarian Law Project, Sorrell v. IMS Health, Christian Legal Society v. Martinez, Pleasant Grove v. Summum, Ysursa v.
