Cette thèse démontre que l'accès à la justice est aujourd'hui théoriquement possible en cas de violation du droit à l'alimentation, les arguments présentés depuis des décennies contre sa justiciabilité étant aujourd'hui dépassés. Cette thèse démontre également qu'en pratique, l'accès à la justice n'est possible pour les victimes de violations du droit à l'alimentation que si ce droit est consacré, invocable et reconnu comme étant justiciable dans un système juridique donné. Ces trois conditions étant réunies dans plusieurs systèmes juridiques nationaux - notamment en Afrique du sud, en Inde, en Argentine, en Colombie et en Suisse - et sur les continents africain et interaméricain, des millions de victimes ont eu accès à la justice en cas de violation du droit à l'alimentation. A survey of the right to property in international law, regional instruments and national constitutions will be followed by an analysis of the scope and content of the right to property and correlative States' obligations. Special attention will be paid to the role of the right to property in the realization of other human rights, in particular the rights to food, adequate housing and social security.
