"In June of 1991, following a series of incidents connected with one of Auckland's major psychiatric hospitals, a number of previously "open" wards at both Carrington and Kingseat Hospitals were locked for a period. This paper is the result of the Commission's response to representations from members of the public concerned at potential breaches of human rights at those hospitals. From the beginning the Commission considered that little purpose would be served by attempting to attribute blame to individuals and a more constructive approach would be to make recommendations which could ameliorate the situation and prevent any similar recurrence in the future. To this end the Commission has taken the principles set down in the relevant international instruments as its guideline. The standards were compared with the conditions as they existed at the hospitals during the period when the incidents provoking the public's concern occurred. Both the international guidelines and the Commission's jurisdiction are laid down in the first part of the document, followed by the theoretical concepts relevant to the mental health area, analysis of the factual material and the conclusions reached by comparison with the relevant principles. To reach its conclusion the Commission felt it necessary to investigate the allegations. Visits were made, on a number of occasions, to Carrington, Kingseat and North Shore Hospitals ... it should be emphasised that the Commission spoke to patients, management, mental health professionals, consumer groups and advocates.
