RFor democratization requirements and human rights respect reasons, Mexico entered since 1992 into a modern legal age in religious matter, changing deeply its separatist and very anticlerical regime in force since 1917. The liberalization of the system put in place the freedom of religion principle as the most important axis of the worship law to the detriment of the separation principle that prevailed until then, and allowed the introduction of the laicity principle, notion little-studied but having a strong potential in the regulation of the relations between state, society and religious confessions. However, the present legislation analysis shows some problems, and highlights the ambiguities of a State that vacillates between a certain juridictionnalism and the full acceptance of a freedom system. In addition, if it is possible to consider that the freedom of religion principle enjoys satisfactory legal recognition and guarantee mechanisms at a formal level, the study of its application in current practise shows the state's management shortcoming, that finds difficulties to defuse the conflicts resulted by the religious pluralization of the society, and to imagine fair and audacious solutions for the new problems. Finally, the freedom of religion's study allows to reach a fundamental rights Mexican State diagnosis, that emphasizes the difficulties of the country to set oneself up as a genuine rightful state, able to ensure the real respect of the freedoms for all
