The german judges and jurisprudence distinguish several effects, or functions, of fundamental rights. instead of distinguishing between subjective effect and objectives effects, as German jurisprudence usualy does, it is fitting to distinguish between, on one hand, a defensive effect (abwehrfunktion) of these rights, which protects a sphere of liberty, inherent in each individual, and which obliges the public power to abstain from every interference (eingriff) in the field protected by each fundamental right, and, on the other hand, positive effects of fundamental rights, recently evolved, which oblige the public power to adopt mesures for promoting and protecting the exercise of these rights. The different positive rights : radiating effect (ausstrahlungswirkung), horizontal effect (drittwirkung), obligation of protection (schutzpflicht), right to allowances (leistungsrecht), obligation of putting into shape (ausgestaltungpflicht), guarantees in matter of organisation and procedure (organisations- und verfahrensgarantien), institutional guarantees, have to be classified. so it is possible to distinguish the positive effects that are characterized by the aim of the action which is requested of the public power : these are the obligation of putting into shape and the obligation of protection, and the positive effects that are characterized by the means that are used : these are the guarantees in matter of organisation and procedure and the rights to allowances. The other effects evolved by the german judges and jurisprudence find a place in these four positive effects from which they are only particular cases

The legal doctrines distinguish traditionally two different models of vertical separation of powers: the unitary state and the federal state, France being supposed to represent the first, Germany the second. Moreover, it is generally acknowledged that federal states are more respectful of local freedoms. However, the decentralization reforms carried out in France and in Germany oblige to question the relevance of this doctrinal assumption and to review the current state of knowledge on the legal systems of both countries. This research is based on an original approach seizing the federalism by the prism of local autonomy and comparing the legal situation of the "local government authorities", respectively in a unitary state and a federal state. ln addition, this comparative research is based on the decentralization theory of Hans Kelsen. This allows avoiding the use of the traditional doctrinal classifications that remain largely determined by the national reference frame. This examination of the legal relationship between central and local authorities allows to note a significant convergence between France and Germany regarding the formal and material protection of the right to local autonomy, in particular due to the constitutionalization of local government law in France. This first research result is confirmed by taking into consideration the "power of surveillance" of the central state on the local authorities, the legal opportunities to interfere in the self-government being even more restricted in France than in Germany. This reveals that federal states are not necessarily providing a greater legal protection of local autonomy than unitary states

The discovery of new biotechnological processes calls into question the ability of the law to provide sufficient protection for human beings from the beginning of their lite. These new methods, such as the CRISPR/Cas9 method -also known as "genome editing" -mitochondrial donation, and the creation of human induced pluripotent stem cells (hiPS cells), make it possible to manipulate and influence in a fundamental way the genetic make-up of one's offspring and future generations. This thesis aims to prepare a draft law addressed to the German legislature. ln so doing, it takes into account two aspects : on the one hand, it aims to optimise, on the basis of a comparative analysis of German and French law, current German legislation by identifying possible advantages of the regulatory approach in France. On the other hand - assuming that the techniques in question can one day be applied with controllable risks - it examines, on the basis of an analysis of German constitutional law, whether such a future application could, in principle, be justified and implements these considerations by drafting a legislative proposal

In 1962, one year after the independence, Kuwait issued its constitution which adopted the Monarchical regime, and organized the formal relations among the different public authorities (Legislature, Executive and Judiciary). The constitution announced the individual rights and liberties as natural rights which are sacred and unalienable. So, it was necessary to provide means to protect such rights. In other words, as most of countries, Kuwait had to overcome the difficulties that related to control the constitutionality of legislations. Therefore, the legislator issued a special law in 1973, that gave a birth to the constitutional court, which is specializing in verifying the constitutionality of legislation. It remains to highlight that the Constitutional Judiciary in Kuwait is not in a shelter away from criticism. Certainly, the existence of a constitutional judge as a guard of liberties is a great step toward the state of law. But in the practice side there are many obstructions that raise doubts about the effectiveness of his mission. This research proposes to identify these obstructions and mentions the efforts to establish a constitutional justice, which seeks to achieve the greater part of the rights and liberties guaranteed by the constitution. Under this title, the comparison with the constitutional council in France may grant us great interests with keeping in mind that each institution exercises its own functions in different (cultures, political, and social) conditions

Les sources constitutionnelles de protection des droits fondamentaux se caractérisent par une grande diversité dans les Etats fédéraux allemand, suisse et américain. Au plan historique, tout d'abord, les instruments locaux de protection des droits fondamentaux ont précédé, et influencé leurs homologues de rang fédéral, avant de venir compléter le champ de protection de ces derniers, laissant ainsi apparaître une fonction supplétive aujourd'hui maintenue. Au plan théorique, ensuite, les droits fondamentaux ne sauraient être abordés que dans une optique de complémentarité et de conciliation. Le standard minimum incarné par les Constitutions fédérales n'impose en effet aux entités fédérées qu'un socle commun de droits, en dessous duquel celles-ci ne peuvent s'aventurer mais au-delà duquel elles peuvent aller. La diversité des droits protégés laisse toutefois place à l'homogénéité de la protection des droits. Cette dernière résulte tout d'abord d'une nécessité. L'Etat fédéral ne peut se penser sans heurt: au sein d'une structure caractérisée par un pluralisme constitutionnel, plusieurs juges peuvent être amenés à faire produire à un même texte des sens divergents. Il importe donc de maintenir une interprétation homogène du standard fédéral de protection des droits fondamentaux. Pour autant, cette homogénéité n'est synonyme que de cohérence et non d'uniformité. Les juges fédérés sont en mesure d'interpréter les sources fédérées de protection des droits fondamentaux afin de venir combler les interstices laissés libres par le droit fédéral! Encore faut-il, cependant, qu'ils s'en saisissent et qu'ils s'insèrent dans la " communauté d'interprètes " propre à l'Etat fédéral

The Treaty of Lisbon introduced a major change in the Union's system for the protection of fundamental rights by incorporating the Charter of Fundamental Rights into primary law. The provisions of the Charter relating to its field of application, which entered into force in 2009, have acquired new importance. Article 51(1) provides that they are "addressed to the institutions, bodies, offices and agencies of the Union [...] and to the Member States only when they are implementing Union law". The wording "implementation of Union law" has, however, given rise to new issues. With regard to action by the Member States, the question arises as to when to apply the Charter and when to apply national fundamental rights. While the analysis of the interpretation of Article 51(1) by the Court of Justice of the Union helps to resolve certain uncertainties, comparison with the interpretations of the national courts also seems essential. The resulting differences of interpretation must therefore be taken into account in order to understand the field of application of the Charter in a heterarchical and pluralist manner. In this sense, differences of interpretation should no longer be seen as an obstacle but as a defining factor
