Het gebruik van grond is noodzakelijk om bepaalde publieke doelstellingen te realiseren, bijvoorbeeld de aanleg van woonwijken, industrieterreinen en wegen. Lang niet alle grond in Nederland is in eigendom van de overheid. Dat betekent dat de genoemde doelstellingen dikwijls (gedeeltelijk) op grond van particuliere eigenaren moeten worden gerealiseerd. Het zelfrealisatierecht houdt in dat particuliere eigenaren - vanwege hun eigendomsrecht op de grond - in principe het eerste recht hebben om tot realisering van deze doelstellingen over te gaan. Het ligt voor de hand dat de overheid hierop een zekere invloed wil uitoefenen. Maar hoe ver mag die invloed reiken? En hoeveel ruimte heeft een particuliere eigenaar om naar eigen inzicht bepaalde doelstellingen op zijn grond te realiseren? Wat is, kortom, de reikwijdte van het zelfrealisatierecht, en in hoeverre mag de overheid dit recht beperken?0Lisanne Groen beschrijft de omvang van het zelfrealisatierecht vanaf het eind van de negentiende eeuw - het moment waarop de nationale wetgever zich voor het eerst begon bezig te houden met ruimtelijke ordening - tot aan het heden. Zij maakt inzichtelijk op welke manier maatschappelijke ontwikkelingen als verpaupering, bevolkingsgroei en stijging van de grondprijzen de overheid tot handelen aanzetten. Explaining goal achievement in international negotiations: the EU and the Paris Agreement on climate change( )

ABSTRACT: The Paris Agreement on climate change adopted in December 2015 reflects EU policy objectives to large extent. To find an explanation, we develop a general framework that incorporates both structural and actor-/process-related factors, paying particular attention to negotiation strategy and diplomacy. On this basis, we argue that the high level of EU goal achievement in Paris resulted from the interplay of (1) evolving international structures, (2) effective EU strategy fitting these structures and domestic politics, and (3) favourable situational circumstances. While the EU arguably pushed others to their limits, downscaled ambitions also meant that it accepted a Paris Agreement that is insufficient by itself and needs to be strengthened quickly. The application of our conceptual framework to the Paris Agreement demonstrates its added value and that it can build the basis of a fresh programme of work comparing the EU's performance in international institutions/negotiations across time and policy fields

Abstract : After its defeat at the Copenhagen climate summit in 2009, the EU can be considered to have scored a relative success with the Paris Agreement adopted in December 2015. With the mitigation ambition of the agreement exceeding expectations, the EU realized its policy objectives to a greater extent than it may have anticipated itself. This success was made possible by a moderation of the EU's policy objectives pursued proactively through an EU bridge‐building and coalition‐building strategy. It was enabled and facilitated by the great‐power politics between China and the US as well as the French Presidency of the Paris conference. With Paris, the EU thus appears to have consolidated its role as a 'leadiator' in international climate policy, which it took on after the failure of the Copenhagen conference and road‐tested for the first time in Durban in 2011. In a multipolar climate world, this new role model should remain relevant for the years to come. However, the unpredictability of the underlying internal and external political, economic, and technological dynamics suggests the wisdom of a regular review and adjustment of strategy.
