ATSIC has compiled 'As a Matter of Fact' in order to help achieve a more enlightened public debate, and to counter the 'myths' and misconceptions that too frequently substitute for knowledge in the area of Aboriginal and Torres Strait Islander affairs. It brings together facts and figures, and interpretations from an indigenous perspective, that have never been published in one place. Contents: 1. HISTORY - Aboriginal history is not Australian history - There's no point in dwelling on the past - what's done is done 2. FUNDING - There's too much money thrown at Indigenous affairs! - Indigenous people get special treatment from governments - Nothing has got better. Why throw away good money after bad? - The money hasn't got through to the people who need it. 3. ATSIC - It's ATSIC's job to fix up all the problems of Indigenous people - ATSIC is not accountable - ATSIC is not representative of Indigenous people 4. In 1997, ATSIC released the discussion paper Our Culture: Our Future: Proposals for the Protection and Recognition of Indigenous Cultural and Intellectual Property, and invited public comment on the need for protecting and recognising Indigenous Cultural and Intellectual Property Rights. The report extracted here was developed in the light of over 70 submissions received on this discussion paper, and also in consultation with a National Indigenous Reference Group and other relevant individuals, communities and organisations. The Report details the types of rights Indigenous people seek in relation to their cultures and considers the application of current laws. This report examines the deaths of indigenous people in custody since the Royal Commission ceased investigating deaths in May 1989. The findings of coronial inquests are used to examine the circumstances of each death to determine whether royal commission recommendations were implemented. Since coronial inquests are limited in scope, only those recommendations concerning the criminal justice and coronial systems are considered. Recommendations concerning land, general health, education, drugs and alcohol, housing and employment will therefore not be considered. The report includes: discussion of the definition of a death in custody, the construction of the profiles, including the dereminiation of a breach of a recommendation and extra-coronial comment, and the method of analysis; characteristics of indigenous people who have died in custody, camparing them to the deaths investigated by the royal commission; comparisons between indigenous and non-indigenous deaths in custody; case profiles under each of the relevant royal commission recommendations; diversion of juveniles from custody; and the treatment of juveniles within the prison system.ins of deceased
