The Treaty establishing a Constitution for Europe was signed in Rome on the 29th October 2004. Despite the uncertainty as to its future, the European University Institute of Florence undertook this collective work which brings together actors closely involved in the process of elaborating the Constitution, as well as academic experts. Part I of the Volume provides a detailed account of this process. It then proceeds to a commentary on the Constitution following a common approach for each topic : it recounts the evolution of the ideas, the arguments, the stakes, the influences and finally the choices that led to the final text. The travaux préparatoires of the European Convention and the documents relating to the intergovernmental conference that followed provide the basic materials. Part II focuses on the future of the Constitutional Treaty and the innovations it contains, taking account of the crisis triggered by the negative referendums in France and the Netherlands. In this respect, several scenarios aimed at getting out of the crisis are envisaged for continuing the reform of the European treaties. The present Volume could contribute to re-launching this process, and shall remain useful whatever the fate of the European Constitution.
