Code annote de la cour penale internationale, 2004-2006 by Cyril Laucci( )

2 editions published in 2008 in French and held by 1,317 WorldCat member libraries worldwide

3 editions published in 2010 in English and held by 905 WorldCat member libraries worldwide

The Annotated Digest of the International Criminal Court, 2008 , is the third volume in an annual series, which compiles a selection of the most significant legal findings from public decisions rendered by the International Criminal Court in 2008. A total of 472 public decisions were reviewed for the preparation of this volume. The selected abstracts include an extraordinary number of landmark decisions on substantive and procedural issues including, among others, the constitutive elements of crimes against humanity and war crimes, the rights of victims to participate in different stages of proceedings, the guarantees of a fair trial, and the prosecutorial obligation to disclose potentially exculpatory evidence in its possession. The year was marked by two new arrests, one in the situation from the Democratic Republic of Congo (Ngudjolo), the other in the situation from the Central African Republic (Bemba), as well as confirmation of charges in the joint case The Prosecutor volume Katanga and Ngudjolo . Finally, 2008 paved the way for commencement of the first trials in the history of the International Criminal Court, which officially began in 2009. Abstracts included in this series were selected based on the following criteria: (i) clarification of a legal issue or interpretation of a legal provision; (ii) implementation or application of a legal provision; and (iii) meaningfulness with respect to international justice, human rights, or international humanitarian law. Passages are normally quoted in English, except where the English translation has not been made available; in such circumstances, abstracts are provided in French with an accompanying English-language summary. Selected abstracts are organized under the relevant Statute, Rule of Procedure and Evidence, or Regulation of the Court. A short description or summary is provided for each topic, and a reference system and index allow for easy reference to other decisions quoted in the Digest series

"The first main prosecutor of the International Criminal Court, Luis Moreno-Ocampo indicted people who were accused of genocide, crimes against humanity and war crimes as defined in international treaties. Prosecutor follows Moreno-Ocampo during his first trial against Congolese army leader Thomas Lubanga, accused of war crimes. The film retraces the history of the controversial Criminal Court and sheds light on the international criticism and problems that a prosecutor without any police power has to face."--Web

The pre-investigation stage of the ICC criteria for situation selection by Ignaz Stegmiller( )

1 edition published in 2011 in English and held by 31 WorldCat member libraries worldwide

Hauptbeschreibung With the first part of this study Ignaz Stegmiller provides an introduction to the problem of pre-investigations, the second part gives an overview of the OTP's structure. Part III addresses how the selection process is performed. In this part, the complexity of pre-investigations is revealed. The three trigger mechanisms - State referrals, SC referrals, and the proprio motu mechanism - are illustrated, Self-referrals are critically analyzed and the author argues that the Prosecutor should use his proprio motu power more frequently. Commentary on the Rome Statute of the International Criminal Court : observers' notes, article by article( Book )

2 editions published between 1999 and 2008 in English and held by 13 WorldCat member libraries worldwide

"On 1st July 2008, the Rome Statute of the International Criminal Court entered into force enabling the ICC, as laid down in the Preamble to the Statute, to affirm "that the most serious crimes of concern to the international community as a whole must not go unpunished and that their effective prosecution must be ensured by taking measures at national level and by enhancing international cooperation". In the second edition of their Commentary, Otto Triffterer and a number of eminent legal practitioners and scholars in the field of international criminal law give a detailed article-by-article analysis of both the Statute as well as the "Elements of Crime" and the "Rules of Procedure and Evidence", adopted by the Assembly of States Parties in 2002, and the "Regulations of the Court", adopted by the Judges of the ICC in 2004. The second edition is a substantially revised and significantly amended version of the first edition of 1999, considering the jurisprudence of the International Criminal Tribunal for the former Yugoslavia (ICTY) and the International Criminal Tribunal for Rwanda (ICTR) as well as other international, "semi-international" or national courts and the relevant literature since 1999. The Commentary will be an invaluable aid to all practitioners and scholars dealing with the Rome Statute and the jurisdiction established by its "Complementarity Regime"."--Publisher's website

This house believes that Arab states should hand over the Sudanese president to the International Criminal Court( Visual )

1 edition published in 2009 in English and held by 10 WorldCat member libraries worldwide

An audience at the Doha Debates has defied the governments of the Arab League and told them to send Sudanese President Omar Hassan al-Bashir for trial at the International Criminal Court. A 350-strong audience voted 55 to 45 percent in favour of a motion: 'This House believes Arab states should hand over the Sudanese President to the International Criminal Court'. Al-Bashir is viewed in the West as a prime architect of the massive human rights violations perpetrated in the Darfur region of Sudan, resulting in at least 200,000, and possibly as many as 400,000 deaths and millions of refugees and displaced persons. Speaking for the motion Ahmed Hussain Adam, spokesman for the Justice and Equality Movement, one of Sudan's main rebel groups in Darfur, said the indictment and trial of al-Bashir was essential for the region and for the world. Hani Shukrallah, co-Editor and columnist for the Egyptian daily Al-Shorouk, who also supported the motion, said the Arab world "as a whole is obliged to atone for the shame of having stood by the massacres of Darfur. He said Arab nations could not accuse the West of double standards "when we have double standards in our own backyard". Ghazi Salahuddin Atabani, a Sudanese politician and adviser to President al-Bashir, was adamant that the evidence against the President was "flimsy" and that the ICC was not fit to try him. Roland Marchal, senior research fellow at the National Centre for Scientific Research in Paris, echoed Atabani in questioning the authority of the ICC and its ability to offer an impartial trial
