A recreation commission jointly created by a city and school district has the statutorily granted contract authority to enter into an interlocal agreement with a private organization for the provision of recreational programming with or without the city or school district's participation. The recreation commission must maintain a degree of oversight that reserves ultimate authority for programming, and other operational decisions in order to provide accountability. A city participating in a joint recreation commission may not enter into any other interlocal agreement for the provision of recreational services with either a public or private entity. We concur with the conclusion expressed in Attorney General Opinion No. 73-242 that unified school district no. 373 does not violate constitutional provisions when releasing pupils during the school day to attend the Newton Weekday Bible School conducted by interested citizens at a church or other designated location. If the policy of the school district is to have school personnel distribute information and materials regarding organizations seeking pupils for enlistment or to permit representatives of such organizations to distribute information and materials on school district property, the school district would not be permitted to preclude the Newton Weekday Bible School or its representatives from abiding by the policy of the school district by either providing for distribution by school personnel information and materials regarding the Bible school or by having a representative of the Bible school distribute on school property information or materials regarding the Bible school. A child is deemed to be enrolled in and attending school unless the child has been inexcusably absent from school for the number of days set forth in K.S.A. 1995 Supp. 72-1113. It is within the discretion of the unified school district to establish criteria for determining whether a child is inexcusably absent for a significant part of the school day. The authority of a unified school district to suspend or expel a child pursuant to K.S.A. 72-8901 et seq. does not extend to cases involving truancy. A unified school district may adopt rules regarding attendance of pupils at school, provided such rules are consistent with state statutes and regulations. A unified school district may adopt an attendance policy under which academic penalties may be imposed for noncompliance. The academic penalties imposed under the policy must be reasonably related to the disciplinary objective sought to be obtained by the school district.
