THE CIVIL ACTION MUST AIM AT THE TRUTH. THE BRINGING INTO PLAY OF THIS SIMPL IDEA IS UNCERTAIN IF THE NOTION OF TRUTH REMAINS ON THE LEVEL OF PHILOSOPHICAL KNOWLEDGE. IT BECOMES REALLY MEANINGFUL IF IT IS TAKEN FOR GRANTED THAT TRUTH HAS A LOGICAL VALUE. DEFINITE WHEN RESULTING FROM THE SYLLOGISME APPLYING THE RIGHT TO THE FACT, THE JUDICIAL TRUTH BECOMES OBJECTIVE WHEN THE PREMISSES ARE CHECKED. AS A RESULT THE JUDICIAL TRUTH IS NOT ONLY BASED ON THE MERE CHECKIG OF THE REALITY OF THE FACTS BUT ALSO ON THE CERTAINTY THAT THE LAW IS CORRECT. ADVOCATING THE DISTINCTION BETWEEN THE FACT AND THE LAW, THE NEW CIVIL CODE OF CIVIL PROCEDURE ESTABLISHES THE JUDGE'S CAPACITY AND POWER TO COLLECT AND INVESTIGATE THE FACTS BUT IT DOES NOT COMPEL HIM TO A SYSTEMATIC SEARCH FOR THE ROLE OF THE LAW TO BE USED IN SUCH OR SUCH A CASE. THE DISTINCTION BETWEEN THE FACTS AND THE LAW CAN'T THEREFORE BE USED TO ESTABLISH THE DISTRIBUTION OF THE PROCESSUAL TASKS, THE FACT AND THE LAW NOT BEING APPROPRIATED. The law of November 15th, 1999 has created a new legal framework open to all couples : it is the civil solidarity pact (PACS). It is presented as a contract which offers legal recognition to adult cohabiting couples. But the true nature of this pact needs debating: it cannot be reduced to a mere contract. However, it is not a real institution either. As a matter of fact the PACS is halfway between both. It is a very specific juridical act. This original nature entals farreaching consequences as to the liberty allowed to the partners to register their union in the pact or to leave it. Given that it is not a sheer contract, neither its conclusion nor its breaking off can be left o the signatory parties alone. The choices of the legislator lead to set the PACS, from its preparation to its dissolution, in the judicial sphere. This interaction betw en the PACS and the Law is the very point of this doctoral thesis. As soon as the PACS agreement is under way, the intervention of the representatives of the Law is necessarily required. When the pact is concluded or broke, the legislator requires that it be declared at the Magistrates' Court, thus relating explicitly the PACS to the Law. Besides, the absences of legislation in the text are such that the judge has to assume the responsibility for establishing this new status, notably when he is apprised f a contentious procedure

Albeit closely associated with public order, enforcement offers a degree of freedom in reaching a consensus ad idem. This is borne out in civil execution proceedings and in fund apportionment proceedings. But this first form of contractual enforcement, which aims to ease the hardship, now coexists with a second form in which consensus ad idem is reached specifically to avoid recourse to civil execution proceedings by reinforcing the obligation to perform. Such agreements tend either to make enforcement ever more subsidiary to voluntary execution or to organize automatic and legally established satisfaction of the creditor despite nonfeasance by the debtor and without the latter's involvement. Whereas in the former case such agreements revert to voluntary execution incentives, in the latter case they provide for forcible, private and alternative execution. Consequently the notion of enforcement has evolved. While this transformation is by and large positive in that it favours and consolidates effective rights, it nonetheless requires that constraining processes be constantly and strictly controlled

Tel un "signe-éclair" traversant le nouveau Code de procédure civile, l'article 21 indique, en une formule aussi brève qu'admirable, qu' "il entre dans la mission du juge de concilier les parties ". Ainsi énoncée, la mission de conciliation du juge civil constitue sans aucun doute l'une des clés permettant d'accéder à la compréhension de l'office du juge, de son évolution, et d'en saisir par-là même tous les ressorts. De par son importance, le sujet ne peut que susciter le débat, nécessairement facteur d'opinions contradictoires. Face aux diverses critiques ou réserves émises à l'encontre de la conciliation lorsqu'elle est l'oeuvre des magistrats, il apparaît essentiel de lui restituer enfin la place qui est la sienne au sein de l'office général de tout juge, de mettre en exergue les fondements d'une telle mission, sa raison d'être, et de prouver que sa mise en oeuvre se trouve être elle-même porteuse des plus grands espoirs. En empruntant cette voie, il ne s'agit pas de restaurer entièrement l'image de la mission conciliatrice du juge comme on restaure une toile de maître abîmée par le temps. Cette mission n'a pas réellement subi d'altération au fil des décennies. Il semble, en vérité, qu'elle n'ait pas été suffisamment examinée ou, plus exactement peut-être, bien mise en lumière. Aussi convient-il de lui apporter aujourd'hui tout l'éclairage qu'elle mérite et de lui donner ainsi son plein éclat

Le procès est souvent dépeint comme un duel. Dans ce contexte conflictuel, l'idée de collaboration peut sembler illusoire, alors qu'elle apparaît au contraire comme étant de l'essence du contrat La réalité n'est pas aussi simple : les intérêts qui se rejoignent dans un contrat correspondent souvent à des renoncements réciproques réalistes plus qu'altruistes ; ceux qui, a priori, s'affrontent dans un procès en arrivent fréquemment eux aussi à composer pour des raisons d'ailleurs variables. La collaboration consiste à associer utilement les parties au procès. Si les intérêts privés peuvent servir des objectifs à visée economique, la satisfaction de l'intérêt général commande aussi que les parties concourent à la légitimité du processus judiciaire. Bien que la collaboration s'affiche comme un instrument de satisfaction de l'intérêt général, il lui arrive malheureusement de participer aussi à son dévoiement. La primauté des intérêts particuliers peut en effet s'avérer contraire à l'intérêt général, en particulier en procédure pénale. L'analyse de la collaboration au procès permet de dresser un bilan général pour appréhender l'équité de la procédure. L'équilibre, en ce sens, peut constituer l'objectif constant d'une collaboration réussie, permettant à chacun d'influencer le cours de la procédure. L'équilibre exalte la satisfaction des parties en même temps que la qualité de la décision. Cet équilibre doit être trouvé entre les intérêts en présence. C'est à cette seule condition que les intérêts particuliers serviront utilement l'intérêt général. Ainsi, la collaboration esquisse une grille de lecture intéressante, susceptible de contrôler la conformité de nos contentieux au procès équitable européen
