The law of November 15th, 1999 has created a new legal framework open to all couples : it is the civil solidarity pact (PACS). It is presented as a contract which offers legal recognition to adult cohabiting couples. But the true nature of this pact needs debating: it cannot be reduced to a mere contract. However, it is not a real institution either. As a matter of fact the PACS is halfway between both. It is a very specific juridical act. This original nature entals farreaching consequences as to the liberty allowed to the partners to register their union in the pact or to leave it. Given that it is not a sheer contract, neither its conclusion nor its breaking off can be left o the signatory parties alone. The choices of the legislator lead to set the PACS, from its preparation to its dissolution, in the judicial sphere. This interaction betw en the PACS and the Law is the very point of this doctoral thesis. As soon as the PACS agreement is under way, the intervention of the representatives of the Law is necessarily required. When the pact is concluded or broke, the legislator requires that it be declared at the Magistrates' Court, thus relating explicitly the PACS to the Law. Besides, the absences of legislation in the text are such that the judge has to assume the responsibility for establishing this new status, notably when he is apprised f a contentious procedure

Bien que profondément marquée par son caractère d'ordre public, l'exécution forcée offre des espaces de liberté dans lesquels des accords de volonté peuvent être conclus. Cela se vérifie à l'occasion des procédures civiles d'exécution et des procédures de distribution des deniers. Mais ce premier mouvement de contractualisation de l'exécution forcée permettant un adoucissement de la contrainte coexiste désormais avec un second dans lequel les accords de volonté sont spécialement passés en vue d'éviter le recours aux procédures civiles d'exécution en renforçant une contrainte à fin d'exécution. Ces accords tendent soit à rendre l'exécution forcée toujours plus subsidiaire par rapport à l'exécution volontaire soit à organiser une satisfaction automatique du créancier juridiquement acquise malgré l'inexécution et sans concours du débiteur. Si dans le premier cas, ils renvoient aux incitations à l'exécution volontaire, ils réalisent dans le second, une exécution tout à la fois forcée, privée et alternative. En conséquence, la notion d'exécution forcée a évolué. Si cette transformation est, dans l'ensemble, positive en favorisant et consolidant l'effectivité des droits, elle impose que l'utilisation de procédés de contrainte reste toujours strictement encadrée

Section 21 of the New Code of Civil Procedure contains a theme running through the code. It states, with admirable brevity, that " it is within the fonction of the judge to conciliate the parties ". Put like this, the judge's role of conciliation is undoubtedly one of the key elements enabling the parties to come to an understanding of the role of the judge, of how this role has developed, and what its parameters are. A subject of such importance necessarily leads to a debate in which contradictory opinions are expressed. In the light of the criticisms and reserves which have been expressed about conciliation effected by judges, it is important to put it in its proper context, as part of the general role of every judge. It is also important to point out the underlying basis of this role, its raison d'être, and also to show that its use gives rise to positive reasons for hope. By going down this route, it is not sought to fully restore the image of the role of judicial conciliation in the same way a old malter, damaged by the passing of the years, would be restored. This role of judicial conciliation has not indeed been the victim of deterioration over the decades, but neither has it, is appears, been subject to proper examination. It is therefore appropriate to subject it to the spot-light of investigation that it deserves, and thus to put it in its true perspective

The study of courts in French law and in Albanian law reveals the extension of the field of use of the specialization. The special courts of law are not the only concerned by the specialization anymore but, in a more general way, the specialization tends to be applied more widely to the whole of the courts. Besides, the specialization does not only concern the jurisdictional institutions, but also the persons responsible for settling lawsuits. French law favours a very large application of the specialization. It is particularly expressed in the separation of the two jurisdictional orders, the separation of the civil and the criminal courts, the attribution of special competences to specialized jurisdictions or even in the specific competence given to jurisdictions of common law on specific subjects. The specialization is here presented under various aspects. It is also expressed by a specialization de facto of the jurisdictional institutions and of the persons in charge of dealing with the lawsuits. As for Albanian law, the specialization is implemented in a more restricted manner. While keeping only one jurisdictional order and only one county court for any law field, the specialization reappears in the setting-up of specialized sections within these jurisdictions.
