The law of November 15th, 1999 has created a new legal framework open to all couples : it is the civil solidarity pact (PACS). It is presented as a contract which offers legal recognition to adult cohabiting couples. But the true nature of this pact needs debating: it cannot be reduced to a mere contract. However, it is not a real institution either. As a matter of fact the PACS is halfway between both. It is a very specific juridical act. This original nature entals farreaching consequences as to the liberty allowed to the partners to register their union in the pact or to leave it. Given that it is not a sheer contract, neither its conclusion nor its breaking off can be left o the signatory parties alone. The choices of the legislator lead to set the PACS, from its preparation to its dissolution, in the judicial sphere. This interaction betw en the PACS and the Law is the very point of this doctoral thesis. As soon as the PACS agreement is under way, the intervention of the representatives of the Law is necessarily required. When the pact is concluded or broke, the legislator requires that it be declared at the Magistrates' Court, thus relating explicitly the PACS to the Law. Besides, the absences of legislation in the text are such that the judge has to assume the responsibility for establishing this new status, notably when he is apprised f a contentious procedure

Section 21 of the New Code of Civil Procedure contains a theme running through the code. It states, with admirable brevity, that " it is within the fonction of the judge to conciliate the parties ". Put like this, the judge's role of conciliation is undoubtedly one of the key elements enabling the parties to come to an understanding of the role of the judge, of how this role has developed, and what its parameters are. A subject of such importance necessarily leads to a debate in which contradictory opinions are expressed. In the light of the criticisms and reserves which have been expressed about conciliation effected by judges, it is important to put it in its proper context, as part of the general role of every judge. It is also important to point out the underlying basis of this role, its raison d'être, and also to show that its use gives rise to positive reasons for hope. By going down this route, it is not sought to fully restore the image of the role of judicial conciliation in the same way a old malter, damaged by the passing of the years, would be restored. This role of judicial conciliation has not indeed been the victim of deterioration over the decades, but neither has it, is appears, been subject to proper examination. It is therefore appropriate to subject it to the spot-light of investigation that it deserves, and thus to put it in its true perspective

Albeit closely associated with public order, enforcement offers a degree of freedom in reaching a consensus ad idem. This is borne out in civil execution proceedings and in fund apportionment proceedings. But this first form of contractual enforcement, which aims to ease the hardship, now coexists with a second form in which consensus ad idem is reached specifically to avoid recourse to civil execution proceedings by reinforcing the obligation to perform. Such agreements tend either to make enforcement ever more subsidiary to voluntary execution or to organize automatic and legally established satisfaction of the creditor despite nonfeasance by the debtor and without the latter's involvement. Whereas in the former case such agreements revert to voluntary execution incentives, in the latter case they provide for forcible, private and alternative execution. Consequently the notion of enforcement has evolved. While this transformation is by and large positive in that it favours and consolidates effective rights, it nonetheless requires that constraining processes be constantly and strictly controlled

Lawsuit is often considered as a duel. In these conflicting circumstances, collaboration seems illusory, whereas it appears to the essence of contract. Reality is not so easy : regarding contract, convergent interests are more realistic renouncements than altruistic ones. Collaboration consists of associating usefully the parties to the lawsuit. If private interests may be of service to economic goals, satisfaction of general interest order also to the parties to work towards legitimacy of judicial process. Although collaboration appears to a way of satisfacting general interest, it may also unfortunately lead to an opposite result. lndeed, giving priority to private interests may sometimes prejudice to general interest, in particular at criminal procedure. Analysis of collaboration permit to draw up a general assessment in order to check up equity of procedure. Balance also constitutes the constant goal of a successful collaboration, which allows the parties to influence the course of procedure. Balance catalyses satisfaction of the parties as well as quality of judgement. This balance must be found between all existing interests. It constitutes the only way to private interest to serve usefully general interest. Consequently, collaboration could be an appropriate tool which permits to check up the conformity of our procedures with the European convention of human rights
