Within disciplines that are traditionally qualified rights public, private and criminal law new branches grow over the changing needs and human knowledge, according to their logic, but sometimes at the expense of the common law . This thesis seeks to determine what branch of law and to apply it to a concrete example: genetics.The concept of law that we propose to define is simple: it is a collection of standards for a specific purpose. A branch is a collection of standards. A discipline is a collection of branches.The distinction of each branch is the theory of fuzzy set, ie it must recognize a limited degree of uncertainty concerning the delimitation. This uncertainty is normal and depends on several factors, including the organization's existing standards or relations between objects right between them.This definition naturally follows two sets of operations.The first is determining the scope of the collection of rules and therefore report it to the standards that comprise it.The second concerns the organization of the rules of this collection. Without being critical of the definition of the branch, it can give a particular cohesion and it therefore presents a theoretical and practical interest.Several types of organization can be considered, and all depend on the material and the angle.However, these organizations can lead to the creation of a code, ie an organized plan by specially adapted and can be recognized by the public authority must be adopted by the doctrine as having a practical for a profession.Following this review, we propose, among other models, a particular organization the right genetics.This organization is the logic from acquisition to manipulation. Based on an empirical study of how academics did or did not adopt new practices after the reform of doctoral school in France, my PhD thesis studies how a top-down organizational reform can change practices among autonomous professionals. New practices are effectively adopted only when they make sense relatively to extant professional identities. The latter do not evolve in response to a precise steering by the reformers, but to new problems definition by the professionals, leading to new ways of doing. Consequently, a radical change of practice implying an evolution of identity cannot be steered from top-down, but only supported by the organizational structure. Regular contacts between professional groups and with other stakeholders (users, citizens, funders) create a favorable context for such a change. My thesis discusses the possible scope of action for reformers in professional public organizations and the levers of change they might rely on

Ces préoccupations traduisent la lecture des aspects économiques, juridique et de régulation de la Concurrence dans le secteur bancaire. Au moment, où les institutions européennes à l'image des divers États membres tentent de trouver un moyen de stopper les effets de la crise. La Concurrence est au cœur des débats. La recherche d'un équilibre entre Concurrence et stabilité économique se révèle indispensable. La distinction de l'imperium et de la jurisdictio est une des plus anciennes distinctions de la science juridique européenne. Entre les mains du souverain, la jurisdictio est le pouvoir de rendre la justice et l'imperium celui d'user de la force. Cette souplesse notionnelle permet à la distinction de structurer l'intégralité du droit judiciaire privé. Dans ce cadre, la jurisdictio se présente alors comme le pouvoir de réalisation formelle du Droit - le Droit est dit - alors que l'imperium vise sa réalisation matérielle - le Droit est fait -. Cette perspective fonctionnelle permet de recouvrir les différents pouvoirs des organes judiciaires, le juge, bien sûr, mais aussi l'arbitre, l'huissier de justice, le greffier, le notaire ou le commissaire-priseur judiciaire. Mais l'intérêt de la distinction ne s'arrête pas là. À l'échelle du jugement, d'abord, la jurisdictio se présente comme la source de l'autorité de la chose jugée ou de l'authenticité alors que l'imperium est à l'origine de sa force, obligatoire ou exécutoire. The question of the good governance settles at present more and more with a lot of acuteness within the world, generally, and in the European Union, in particular, indispensable condition of membership for quite former and future member. The success of a good governance leans in particular on a high level of responsibility of the government the role of which lives in the effort to strengthen the rule of law and the democracy. The observable deficit of this responsibility in countries stemming from the Communist Bloc, mainly Romania, is caused by the low institutionalization, by the failing components of the rule of law, by the legal instability, by the uncertain process of the irreversible reforms and by the precariousness of the ethical dimension of the conducts. These causes inevitably activated a symptomatic phenomenon of the crisis of the establishment of the rule of the law: the corruption. The stakes in the corruption determined the indelible intervention of the European Commission, after the membership of Romania. Paradoxically, the wrestling about anticorruption, inexorably been imperative by the European Union, envisaged perspectives of legal and ethical normative harmonization. As a matter of fact, less corruption leads to more responsibility. Sometimes, the process of effective implementation of the reforms turns out risky because of the split of the political parties, led by private interests. For that purpose, the role of the ethics, thanks to the practical pedagogy, must be more valued. From now on, it is necessary to enrich the political and administrative persons in charge of an honorable conduct, a high consciousness, purely and simply them to give responsibilities

The theory of the defect of consent offers a generic protection of the contracting party against all risk of consent modification. Having noticed its inadequacy, the laws of consumerism and competition have chosen to adopt a set of specific rules aiming to protect on one hand the consumer, and on the other hand the professional, both in a weak negotiating position, against these same risks. Within the consumerism law, this has been achieved under the European Rights impetus. The 11 May 2005 directive concerning unfair business-to-consumer commercial practices has largely dictated the content of the protective measures nowadays applicable to customers. In the same way, the Second Title of the First Book of Consumer Code, dedicated to commercial practices, consists of a preliminary chapter establishing the unfair business-to-consumer commercial practices. It follows by the 1st chapter, where the 1st section deals with misleading commercial practices, whilst the 2nd chapter, 5th section deals with aggressive commercial practices. Hence the competition law has resorted spontaneously to this option. Fourth Book includes fourth Chapter, where the second Chapter relates to the ban of competitive restrictive practices. These ones, forbidden per se, apparently have no link to this theory of the defect of consent. However, if we look closer, some of them have indirectly the aim to balance present forces at the negotiation stage via a distribution contract between professionals. In fact some will be keen to ban certain professional's behavior that, having a certain economical advantage, could be tempted to play in such a way so as to acquire unjustified contractual advantages from contractual partners, economically dependent. In doing so, the latter would need to have their consent protected.By developing such legislation, special laws have distanced themselves from their mutual purpose. Thus, if it is true that the consumerism law offers a set of rules aiming to prevent any defect of consent should it arise, it equally proposes a multitude of preventive rules but of a delicate maneuver - this being an original approach within the theory of defect of consent of common law, trying to repress the abuse effectively altering the contractual consent. Their comprehension as well as the putting it into practice would require a certain skill, to the point of risking the protection effectiveness that it aims to provide. As to the competition law, a set of rules aiming to forbid per se sensitive behavior, it would endanger only particular interests of professionals in a weak negotiating position, and not the whole market, manifestly tending to divert the matter from its initial result.To find a solution to these observations would imply to take into account the possibility of cutting off special rights of certain legal rules aiming to protect contractual consent they are under the obligation of, in favor of the theory of defect of consent. Such solution would lead to re-focusing on consumer and competition laws around their respective result, which are on one hand the protection of consumer's personal interests, and on the other hand market protection. It would then mean that the contracting party, sheltered by special rules, would not see their protection level diminish. To be re-assured there's the need to determine the nature of the improvements the theory of defect of consent would require, so as to include a part of the litigation of special law. The latter, inspired by a study of special law, could then benefit of the whole contractual under the common law

The evolution was marked in a radical way by the scientific revolution inaugurated by Copernic as for the universe and by Vésale as for the body. Under the aegis of Galilee then of Descartes, the body - already underestimated by the dualism of Platoon - saw itself reduced in the status of object of science, mechanics, under the ascendancy of the epistemological dualism. The purpose of this work is first of all to try to understand the progression of such a reduction, to show its origins as well as its past and current drifts, with their ethical consequences, since it is a question of thinking the body and, by it, of the medicine. Ce travail doctoral vise à étudier le rôle de la confiance initiale dans la phase d'établissement de la relation entre le consommateur et une marque. Pour ce faire, nous avons tout d'abord effectué une étude qualitative exploratoire auprès d'un échantillon de 24 personnes. Dans le cadre de cette étude, nous avons opté pour le cas d'une marque nouvelle pour les interviewés car c'est précisément dans ce cas de figure que la confiance initiale devrait être le plus difficile à établir pour la marque. Les résultats de cette étude exploratoire révèlent l'existence d'une confiance initiale du consommateur envers une nouvelle marque. Celle-ci fait référence à une présomption par le consommateur que la nouvelle marque puisse être fiable et intègre. Elle se forme à partir de quatre types de facteurs : les facteurs liés à la marque, les facteurs liés aux tiers, les facteurs liés au consommateur et le facteur situationnel. Enfin, elle engendre deux conséquences : l'intention d'achat de la nouvelle marque et l'intention de recommander la nouvelle marque à l'entourage. Nous avons ensuite réalisé une enquête en ligne auprès d'un échantillon de 421 femmes afin de vérifier nos hypothèses de recherche. Elle s'est effectuée par le biais d'un questionnaire précédé d'un scénario et portait sur une nouvelle marque de crème anti-rides qui a été conçue pour les besoins de la recherche. Les résultats de cette étude montrent que : (1) la confiance initiale envers une nouvelle marque est un concept unidimensionnel et non bidimensionnel ; (2) certains facteurs influencent positivement la confiance initiale envers une nouvelle marque : la perception positive du bouche à oreille, du point de vente, du pays d'origine et du packaging de cette marque ; (3) d'autres facteurs influencent négativement la confiance initiale envers une nouvelle marque (la perception du prix élevé de cette marque) ou n'ont pas d'influence sur cette dernière (la perception positive de la publicité de cette marque, la propension à faire confiance et l'ouverture d'esprit du consommateur) ; (4) le risque perçu lié à la catégorie de produits a un effet modérateur sur les relations entre la perception positive des signaux émis par les entreprises (le prix, le pays d'origine, le point de vente, le packaging et la publicité) et les tiers (le bouche à oreille) d'une part, et la confiance initiale envers une nouvelle marque d'autre part ; (5) la confiance initiale envers une nouvelle marque est un déterminant de l'intention d'achat et l'intention de recommander cette marque.Mots clés : confiance, confiance initiale, marque

The ICC jurisprudence has been abundantly commented and compared to the others ad'hoc tribunals' works. However, its interaction with the international system (states, international organizations) was not as closely examinated. As an integral part of this system, the court can not be considered as a lone element. It is impossible to understand the prosecutor strategy if the wants and preoccupations of the international society are ignored. As such, the jurisdiction promotes values and ideologies coming from some states or some continents. They are largely accepted by the community of nations but this can validate some states' resistencies to the Rome Statute.The African Union claims that the ICC is partial, made solely for the weaker African nations, and is just another form of neocolonialism. It is true that international NGOs such as Human Right Watch consider most of its leaders as perpetatrors of Human Rights violation. Does it mean however that their concern must be dismissed? When experts analyse the Court or the Security council involvements they failed to point for example the illegitimacy of the five permanent members when it comes to Human Rights. The U.S intervention in Irak is seen by many as a crime of aggression and their inability to move the Security Council in their favour prompted their reaction to invade Syria. The lack of concern of the international community for this new development's illegality is another sign of the inequality of treatment between nations. Mass medias' role will not be forgotten in this research.The Court reacts to this unfair environment and its cases are chosen accordingly. When the Rome Statute was elaborated, the redactors tried to preserve state sovereignty. But in fact they insured that the most powerful states will escape the jurisdiction of the Court.In this paper, we will examine the claims of partiality and dependence of the Court and propose some changes to make it a more equitable and fair jurisdiction

Neurological diseases affecting consciousness are the worst ordeal inflicted to the power of our mind (1), to our autonomy and independence. Even if medicine faces this drama with more and more precise diagnoses, therapy often remains helpless. Medical staff then confronts an ethical challenge when meeting this hurted human being, who experiences difficulties to be part of the world, as well as to claim his/her own identity and free will (2). How can we provide a fair and helpful medical care in these tragic situations? How can we preserve patient's autonomy without denying his/her extreme vulnerability? How should we consider the person when their consciousness is gone? (3) Finally, when close to the endpoint, how can we avoid "unreasonable" obstinacy as it is described by the law?In this work, we suggest balanced responses to these questions, considering the graduated levels of consciousness, in both its states and its contents. These responses contrast with those of the law or of oversimplified principles, that are inevitably binary. Yet, handling complexity does not preclude audacious challenges or wise limits. Betting on abilities rather than disabilities does not help the patient to recover; however, it represents a total shift in the caring relationship, by aiming to preserve autonomy, even if supported.These issues concern extreme vulnerability, as well as limits of human beings and medicine. They question both our responsibility and generosity, and invite us to avoid abandonment, violence as well as obstinacy. That is what ethics by essence: the search of a practical wisdom attenuating the tragic aspects of situations

A partir de 1948 la société palestinienne est déstabilisée suite à la guerre qui voit la perte de la Palestine historique. La grande majorité des Palestiniens se retrouve dispersée dans les pays de la région et au-delà de la Méditerranée. Aussi l'élite ancienne construite à partir de fondements religieux, familiaux ou de richesses foncières se retrouve elle aussi expulsée de ses terres. Elle perd donc ses positions de privilèges, désemparée et désorientée, elle ne reviendra plus jamais au devant de la scène nationale palestinienne. Ce sont les hommes qui dirigeront la lutte pour la récupération de la Palestine de 1948, ensuite et à partir de 1967 contre l'occupation de la Cisjordanie et de la bande de Gaza (partie de la Palestine historique) d'abord sous forme de lutte armée ensuite par la diplomatie et la politique de négociations, qui deviennent les nouvelles figures sur la scène politique palestinienne. Ils sont originaires non de l'ancienne bourgeoisie religieuse et familiale mais de la classe moyenne des villes et des zones rurales qui vont recruter dans les camps de réfugiés les futurs combattants. Ce sont les nouveaux dirigeants. C'est un processus qui a commencé dès la moitié des années 1960 pour se consolider avec la création de partis et mouvements palestiniens opérant dans les divers pays d'accueil de la région. Cette nouvelle élite se conforme aux changements et aléas de la diplomatie internationale et d'un rapport de force inégal face à Israël tout au long du conflit israélo-palestinien. Pour comprendre l'évolution des élites palestiniennes il fallait donc adopter l'approche historique des événements et faits marquants touchant le peuple palestinien depuis 1948 jusqu'à l'après-Oslo (1993) ; vingt ans d'Autorité Nationale Palestinienne caractérisée par une souveraineté limitée aux principales villes de la Cisjordanie et de la bande de Gaza, au contraire de ce qu'avaient stipulé les Accords de 1993 : ceux-ci devaient progresser vers le statut définitif des Territoires occupés en 1967. C'est dans ces territoires occupés depuis 1967, en Cisjordanie et dans la bande de Gaza, que se situe donc notre terrain de recherche. À partir de 1993 les dirigeants rapatriés de l'exil formant les membres dirigeants de l'Autorité nationale, vont favoriser les initiatives de palestiniens, en particulier, les figures proéminentes des villes, dans la création d'établissements universitaires. Ceci est entrepris non seulement pour répondre aux besoins d'éducation d'une population jeune dans un acte de résilience face à l'occupation, mais aussi pour répondre aux exigences du projet de construction des institutions du futur Etat à l'intérieur des Territoires de 1967. De nouvelles compétences, de nouveaux savoir-faire devenaient nécessaires dans cette nouvelle situation du post-Oslo où, en parallèle à la lutte politique, l'enseignement supérieur devenait un enjeu vital pour l'existence de la société palestinienne dont l'ambition est d'avoir une place à part entière parmi les nations modernes du monde. D'autres figures émergeront à partir de ces universités pour former une nouvelle et différente élite qui gouvernera dans un contexte de règles démocratiques où le pouvoir ne sera pas exclusivement dans la main de quelques dirigeants. L'OLP, dès 1990, va créer une Université pour tous, l'Université Ouverte Al-Quds (l'UOQ), se basant sur le mode ouvert et à distance. C'était un choix devenu urgent pour surmonter les difficultés et les entraves qu'imposait l'occupation. L'UOQ connaîtra un grand succès comme en témoigne le nombre grossissant de ses inscrits dans un contexte de tension. Plus tard et malgré son offre limitée dans les disciplines d'études, elle va attirer les jeunes à la recherche d'un métier, les adultes pour poursuivre des études inachevées, les femmes pour la proximité de ses centres d'études

Nombreux sont les ouvrages juridiques qui étudient le crime et la réponse judiciaire. Mais rares sont ceux qui mettent en avant une approche pluridisciplinaire pour interroger les fondements et principes du Droit dans ce domaine. C'est la raison pour laquelle cette thèse envisage le phénomène criminel, la mise en oeuvre de la répression (recherche de l'infraction jusqu'à la condamnation définitive du coupable) et la peine à travers la littérature, et plus particulièrement deux auteurs majeurs que sont Dostoïevski et Genet.Tous deux proposent une analyse du phénomène criminel (crime, auteur et victime) qui, de par son originalité, pousse le lecteur à s'interroger, voire à reconsidérer la définition posée par le Droit. La réponse judiciaire apportée par ce dernier est également remise en cause par Dostoïevski et Genet qui insistent sur la faillibilité d'une justice rendue par les hommes. Le procès est une étape considérée comme obligatoire par les deux auteurs et l'exécution de la peine nécessaire; cependant leurs écrits interrogent l'impératif de proportionnalité et d'humanité de la répression

This research aims to explore the concept of oppositional loyalty of the individual and its potential to enrich the concept of brand loyalty as traditionally addressed. Brand loyalty, so far defined as a repetitive buying behavior together with a positive attitude toward the chosen brand, acquires a new component borrowed from the literature on anti-consumption and resistance that constitute, together with social identity and balance quest, the theoretical framework on which this research is based. Based on the smartphones field, the research methodology is structured around three main data sources: online internauts' comments, interviews and life stories. These data were processed through a classical thematic analysis of content. The main results highlight the existence of an oppositional loyalty of the individual that is based on positive attitudes and behavior towards the chosen brand and negative ones towards the avoided brand. When it comes to management in English law, trust law often is an important issue. Company directors, solicitors, trustees managing estates equally are fiduciaries and therefore have to take similar rules into account notwithstanding specific legislation. Thanks to Equity, the English share a common framework which allows them to deal with almost every situation in which management is required. Frenchmen do not rely on Equity and its principles to manage property. This work analyses the following case : an owner enters into a contract in order to have his property managed by a manager. Numerous techniques are available under French law.All of them are related to ownership or agency. Since a fiducie inspired by trusts has been introduced as an ownership-based technique trusts are studied alongside ownership-based techniques. The key role of fiduciary duty is analysed. The first part of this work shows that to manage effectively across time a manager must exercise two powers. The first one called organisation is the ability to act, the second one called direction is the ability to decide whether to act. The second part focuses on framing a new approach of management in French law

After a semantic analysis of the notion of Good Governance, to light the sense of this complex notion, notion the origins of which go back up to a rather distant time. This principle, which built itself through centuries, concerned at first the world of companies, before invading the field of the politics, in the quest of the best management of the public affairs, to satisfy at best the affairs of the State. As therapy, organized by the international institutions, to bring out the African states, often corrupted States, of the tunnel of the poverty and the underdevelopment, it showed itself ineffective. The good governance in its implementation, in Africa and in Ivory Coast, faces a world where the political game set, is influenced by clan, family, tribal links, which put the interest of the groups above the general interest, engendering a decay of the State, with an absence of ethics, responsibility of brightness in the decision-making, in the societies where the quest of the democracy is marked with the seal of the demagoguery, with a premium granted to the opacity in the management of the public affairs. This quest of efficiency is counterbalanced by the weight of the traditions and the practices inherent to the world of the Third World, the things which return the with difficulty effective management of the public affairs. However, the political arena does not escape the influence of the outside world, which influences decision-making, with public actors often subjected to the orders of this capitalist world, in a world marked with the seal of the globalization and with the globalization

The legal representation of the minor is an imperative and a general attribute of the parental authority. It compensates the general incapacity of the minor exceeding the classical distinction between parental authority over the person and parental authority over the goods, but it is inseparably linked with the power of direction and control over the person of the child. It remains however subject to division regarding the determination of legal representative or the regime of legal acts. As a parental prerogative, it is implemented in an authoritarian way because the will of the minor is excluded, but the moderation of the power and the association mitigate the constraints of the representation.
