The anticompetitive impact of regulation( Book )

8 editions published in 2001 in English and held by 215 WorldCat member libraries worldwide

This timely book addresses the important issue of the negative effects of anticompetitive regulation on industry and the massive economic harm it causes. The distinguished contributors, including economic and legal scholars, advocate the need for a review of all anticompetitive laws and address several industry and country case studies with the ultimate aim of providing recommendations to eliminate the impact of anticompetitive regulation. The first part of the book considers regulations affecting private business and professions, part two covers public utility and public services regulation, whilst part three discusses the role of institutions and competition authorities in relation to anticompetitive practices. The authors draft guidelines, based on economic evidence and legal arguments, which they believe would provide a starting point for the European Union to address the problem. They go on to propose possible implementation strategies for these guidelines from both an institutional and legal perspective. The book also includes a historical perspective on the evolution of anticompetitive regulation complemented by an overview of the actions currently being implemented to address and reverse the problem in other jurisdictions

The European Constitution : cases and materials in EU & member states' law by Giuliano Amato( Book )

21 editions published between 2007 and 2010 in English and held by 166 WorldCat member libraries worldwide

"This book offers a selection of materials that enable a better understanding of some of the most important changes that would be introduced by the Treaty establishing a Constitution for Europe in the EU legal and political system. It also helps to assess the need for the reforms embedded in the Constitutional Treaty as well as the quality of the formulations agreed upon by the signatory Member States. The book includes excerpts of the European Convention's work, selected statutory and constitutional provisions of the Member States, and also related passages from pertinent court decisions - from both European courts as well as Member States' constitutional courts. Institutional and doctrinal analysis and relevant excerpts from the Constitutional Treaty itself are also included. Many of these documents directly relate to the provisions of the Constitutional Treaty, while the others, although not directly related, are nevertheless relevant to the debate surrounding it. "The European Constitution", by two of the best experts on the Constitution for Europe, will be of great interest to researchers and teachers in the fields of European Law and European politics, and also to policy makers in European affairs"--Provided by publisher
The history of the European Union : constructing utopia by Giuliano Amato( Book )

14 editions published in 2019 in English and held by 141 WorldCat member libraries worldwide

Présentation de l'éditeur : "The European Union celebrated its 60th anniversary in 2017, but celebrations were muted by Brexit and the growing sense of a crisis of identity. However, as this seminal work shows, the history and ambition of the European Union are considerable. Written by key stakeholders who, between them, acted as architects, adjudicators and arbitrators of the project, it presents the definitive history of the first two generations of the European Union. This book revisits the birth and consolidation of the great project of a united Europe and the political, institutional, judicial and economical frameworks of the European Union: from the process towards integration, to the advancements and the impasses in building a political union."
Genèse et destinée de la Constitution Européenne : commentaire du Traité établissant une Constitution pour l'Europe à la lumière des travaux préparatoires et perspectives d'avenir = Genesis and destiny of the European Constitution : commentary on the Treaty establishing a Constitution for Europe in the light of the travaux préparatoires and future prospects( Book )

11 editions published in 2007 in French and English and held by 97 WorldCat member libraries worldwide

The Treaty establishing a Constitution for Europe was signed in Rome on the 29th October 2004. Despite the uncertainty as to its future, the European University Institute of Florence undertook this collective work which brings together actors closely involved in the process of elaborating the Constitution, as well as academic experts. Part I of the Volume provides a detailed account of this process. It then proceeds to a commentary on the Constitution following a common approach for each topic : it recounts the evolution of the ideas, the arguments, the stakes, the influences and finally the choices that led to the final text. The travaux préparatoires of the European Convention and the documents relating to the intergovernmental conference that followed provide the basic materials. Part II focuses on the future of the Constitutional Treaty and the innovations it contains, taking account of the crisis triggered by the negative referendums in France and the Netherlands. In this respect, several scenarios aimed at getting out of the crisis are envisaged for continuing the reform of the European treaties. The present Volume could contribute to re-launching this process, and shall remain useful whatever the fate of the European Constitution. For whatever its destiny may be, its genesis will remain in the annals of the European integration process"--Provided by publisher

Grandi illusioni : ragionando sull'Italia by Giuliano Amato( Book )

5 editions published in 2013 in Italian and held by 50 WorldCat member libraries worldwide

"This remarkable book offers a first in-depth analysis of the Treaty establishing a Constitution for Europe. As the author - constitutional law expert Jacques Ziller - notes, the new Constitution is in many ways a grand integration of elements from existing European law (most importantly from the case law of the European Court of Justice), yet at the same time the new text features groundbreaking innovations with far-reaching implications for the future of Europe." "Combining legislative history, acute insight, rigorous analysis, and detailed supplementary information, The European Constitution elucidates the genesis, growth, and future implications of the EU's constitutional development."--BOOK JACKET
