La Cour européenne des droits de l'homme, le Comité européen des droits sociaux ainsi que la Cour de justice de l'Union européenne affichent une apparente homogénéité derrière laquelle se cachent des réalités différentes qui fragilisent le principe de non-discrimination et affaiblissent son rôle pourtant central dans le renforcement du droit européen des droits de l'homme. Ce principe doit ainsi être redéfini afin de retrouver une pleine efficacité en tenant compte du fait que son interprétation ne peut différer d'un espace européen à l'autre. Ce défi majeur conduit à analyser en quoi consiste précisément, pour l'Europe, le caractère axiologique du principe de non-discrimination

Conflicts between fundamental rights have become one of the most important and controversial topics in the international human rights field. Conflicts between rights are a complex matter that should be handled carefully. It requires rethinking the Court's function in the international legal order, which is the subject of strong divergences. This thesis aims to present the European Court of Human Rights' reaction when facing this difficult topic. Conflicts between rights highlight the fact that the State remains the most important actor in the protection of human rights, which is paradoxical in light of the traditional assumptions in that field. As a consequence, conflicts are solved with classical tools such as proportionality, now progressively replaced in literature by pratical concordance. Though the Court identifies conflicts in its recent case law, there is still no generally agreed view on the subject and th Court faces strong criticism. Case law is said to be unpredictable because of the "Abwägung im Einzelfall" that characterizes European proportionality. This thesis attempts to systematize the case law through a renewed framework. This idea is not to reject proportionality or practical concordance but simply to propose a framework that fits into this environment and accepts hierarchy as a useful element in order to solve those particular conflicts. Although this framework does not lead to the use of an abstract hierarchy of rights as a method, it seems irrelevant to deny the global idea of hierarchy while proportionality itself refers to scales of values, to weighing interests and rights
